Hello I have searched but found no answer to my question/situation.

My USC wife and I filed the relevant paper work, I485/I130, USCIS has requested that she file the I864, however she has never filed an individual tax return, yes even up to last year in her mid 20's she has filed with/through her mother as the family they live together and are very close.

She is currently unemployed, we had always planned to use a sponsor (my mother) since she clearly would not meet the financial requirements.

Question: Since she does not have any individual tax returns, can she just fill out the I864 and state this fact in a cover letter?

she should have sent the i864 in the AOS packet, she has to send the i864 and the letter as you said stating why she doesn't have to pay taxes, and your mother's i864 as joint sponsor with all the documentation.

did she file the rest of the forms, including the i693 medical and vaccinations done by the civil surgeon?

What visa are you AOSing from?

You are the immigrant and you say you are using your mother as a joint sponsor... she must be a USC or an LPR.

Even if she doesn't have any income (zero) she still submits an I-864 with current income is zero, then explain it like "my spouse is jobless" on the package cover letter. My husband just typed "My wife is a full-time student" and that's it. No need to tell whole story I believe.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
