So my wife and I are ready to file the AOS for to adjust her status (im the petitioner and she came here on the K1, now we're married).

Some questions:

1. For the I-864, it asks for the most recent tax year. Well that means 2011. Unfortunately, I haven't yet filed the tax return for the year 2011. And Even if I did, I wouldn't have the tax transcripts for 2011, until much later in the year. So in Question 25, having to do with Federal income tax information, can I indicate 2010 as the most recent ? I plan to use the transcripts from 2010, 2009 and 2008 in sponsoring my wife.

2. Can we use the same Letter for the Employment that we used for the K-1 Visa proces?. Pretty much nothing has changed, only thing is that its dated September 2011, don't feel like bothering my employer for another letter. I also plan to use my paystubs for the past 3 months (November 2011, December 2011, January 2012).

3. We want to send some pictures along with the I-485 application. We had a civil/court wedding. My parents took pictures there and we plan to use those pics. Would they be okay? Can we also send pictures in which my wife and I are at a temple (a few days after the wedding), in which we are attending a ritual that is primarily intended for newlyweds ?

Thanks,

Chigs

I don't think using your 2010 transcipts should be a problem as long as you file AOS before the tax deadline.

Doesn't it state in the requirements that you need a employment letter and it may be good to get one with a recent date on it.

You can send pictures with the I-485 but you will probably need to bring them with you as well to the interview, if you are given an interview date.

(1) The most current is 2010 unless you have filed 2011

(2) I think they require the last 6 months of your paystubs. You don't need a letter if you have the stubs.

(3) Do not send pictures. They may look at that during your interview, if you have one.

Actually the instructions state that you are not required to provide a letter of employment, it only states that you can provide it as evidence. Not required.

Here is the excerpt from the instructions on the I-864 on income requirements:

You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income. You are not required to submit this evidence, however, unless specifically instructed to do so by a Government official. For example, you may include a recent letter from your employer, showing your employer's address and telephone number, and indicating your annual salary. You may also provide pay stub(s) showing your income for the previous six months. If your claimed income includes alimony, child support, dividend or interest income, or income from any other source, you may also include evidence of that income.

They choose pictures from the batch that you take to your interview. They know which ones to select. I wouldn't send pictures beforehand. If you have an interview, they may ask questions surrounding the pictures. It doesn't make sense sending wedding pictures now. That doesn't strengthen the case on its own, because pictures can be photoshopped. Anyway, it's up to you.

Ummm, you're thinking strictly from the perspective of the interview. Yes, they will choose the pics and will ask us to describe whne they were taking, what was the occasion, who was present, etc... But that's if we have an interview at all. However, as I already mentioned, ours was a court wedding. So nothing fancy. I just had my parents and a close friend attend.

I basically want to know if its okay to send these pictures. We don't have any exquisite pictures of a grand wedding and a reception because that never happened.

So will those pics be okay to send, we will also include descriptions of who/what/when/where on the back of the pics for clarification.

Thanks,

Chigs

Not necessary to send pics. They will have your marriage Certificate as proof. I would get another Employment letter, your HR dept should give it to you no problem, why risk a possible RfE at this point. We had an interview before getting the GC, piece of cake. Showed them a few pics, personal insurance cards, bank statement, utilities bills. 15 minute process, GC arrived 14 days later. Good luck.

You are not required to send any proof of a bona fide marriage for the I-485. No photos, joint leases, anything. You can send it if you want, but it is not required.

The checklist page for the I-864 on uscis.gov says that you must provide proof of current employment, either pay stubs or an employment letter. I know that the I-864 instructions themselves contradict this, but a very common RFE is for proof of current employment.

Pictures and other evidence are not needed at this time. You only need to put in a copy of your certified marriage certificate as proof of marriage. Save the other evidence, like wedding photos, joint accounts/lease, etc. for the interview, if you even have one. Not all K-1s applying for AOS have an interview.

The employment letter seems like the date is current enough. It is less than 6 months old, and as you said, nothing has changed. Just send a copy of it along with your most recent pay stubs. Using the 2010 tax transcripts is fine. 2011 won't be required until after the April tax deadline.
