London 2012- K1s from NOA2 to interview thread

Timeline

We're in a nearly identical situation. Since it's been 4 weeks, you can call the embassy and ask them for an e-mail code. Once you e-mail the embassy with this code, someone will look into your situation. My fiance did this a few days ago and got an automated reply that he would receive word in 3-4 business days. They were closed the past 2 Mondays for holidays, so I think this is what's put them behind. I've been calling the Department of State daily this week, as they sometimes have more up-to-date information than the Embassy.

I am going to do that early tomorrow morning before work. I called DoS today, and they also confirmed the packet 3 information was received as was the medical, and still no interview date. The packet 3 letter was never received by my fiance or by our lawyer, so going to ask about where it was sent to, and try to prevent something similar from happening with the packet 4 interview letter.

Hi guys, another day, another Tax question.

Here it goes! The person who was supposed to be a co-sponsor for us kinda bailed on us, so we are looking for another one because I'm a recent law school grad and I dont make above the poverty line......yet. We have found someone else, but she kind of being abrasive about the employment letter. It seems as though she is willing to provide her W2 and pay stubs but the letter from her employer, Tax transcripts and Letter from bank are what she doesn't seem to have the time (or energy ) to provide. So the question is, will the I-134 be okay with just 2 pay stubs and a tax return? I am particular about the letter from her employer because I have seen in recent interviews, people were asked specifically for the letter from the employer. Or am I just being overtly analytical?

Also, I'm filing out an I134 form with my tax transcripts, and he ( beneficiary) is filling out one with his pay stubs, bank statements and letter from his employer. So cumulatively, will this be okay?

Only the sponser needs to fill out the I134. So if you are below the threashold, you don't fill one out and your UK fiance certianly doesn't fill it out.

These are most important.

It might be possible to get approved with pay stubbs and a tax return but is it worth the risk? Also just because that gets accepted doesn't mean they will accept it for AOS.

Honestly I know its difficult but I would try and find somebody who is 100% co-operative.

Agree with Robert about only one sponsor needed. If not you, then somebody else.

You do not have to have an employer letter or bank letter. Prove the income however you can. Prove it in two ways is enough.

Please note: tax forms PLUS w2 is a complete tax return. That is one proof. In one sentence you said w2 and in another you said tax return. It hajs to be both to be one proper tax return.

Tax transcript is a different way to provide income tax info. Tax transcript does not require W2. Pick one or the other--complete tax return or tax transcript.

If you get tax info and pay slips, you have enough without employer letter. Bank letter is more useful when you don't have an income, but can qualify because you have a huge stash of cash in the bank.

So I am totally disagreeing with

1) Statment from his bank

2) Statment from employer

Thanks Nich-Nick. I thought so too. But being that the website specifically says copies of Tax return are needed if self employed, I got a little worried. It also says nothing about pay stubs too, so I'm still unsure.

For what its worth, I'll keep reading reviews from others to see what they submitted. I need to make a decision soon tho...

For self employed, yes tax returns, but that is a different situation with no employer and many business expenses that can be deducted from the gross income/sales. They need to see the income after all the business write-offs have been taken.

I answered based on reading London experiences for 4 years. They've tweaked many procedures over that time, but they still will accept anything that clearly proves the sponsor can support the immigrant to their satisfaction. I dont even work, so my income tax return was my best proof to show my taxable income was well above. I didn't have an employer letter or pay slips. I didnt get a letter from the bank. Just show them the money the clearest believeable way possible and they will accept it in London. There is not even a fixed number written into law, like with the stricter I-864. It is a subjective decision by the officer doing the interview. In general , 100% of the poverty level will be accepted. http://travel.state.gov/visa/immigrants/types/types_2994.html#8

I think you will find if the sponsor shows good income, they won't even discuss it at the interview.

This is where we are too. They've confirmed that the packet 3 and medical are logged, so we're just waiting. My fiance spoke to the embassy as well, and they said there's just a queue and we'll get scheduled when it's our turn.

Thanks Nich- Nick. She's agreed to send her tax return (complete :-)) and 2 pay stubs. All in all, that should be enough.

If she doesn't want to share her tax info with you, she can seal it all up in an envelope that says "to be opened only by US Embassy official". That gives her a little privacy about her finances. You turn in the sealed envelope at the interview, they file it, and you don't know her business.

So my fiance is mailing off his affidavit of support form and supporting evidence tonight and I was just wondering if photocopies of pay stubs etc.. are good enough to prove his income or do they have to be originals? :blink:
