I just wanted to ask something which is niggling me a little bit. At the medical today on the questionnaire they give you, it asks if you've ever had a serious mental illness (ie. depression). Of course I had to put yes, though even the Knightsbridge Doctor didn't really think it should be classed as such as a lot of people get it.

Now, when I filled out the ESTA form back in Feb 2012, I put "No" to the A) Do you have a communicable disease; physical or mental disorder; or are you a drug abuser or addict?" question. I didn't have one at the time. Now, I was supposed to be on anti-depressants when I travelled to the US in December, though I wasn't taking them and I felt fine. I went to my GP as soon as I came back and he said I was fine then.

I'm worried that I put the wrong thing down for ESTA because I put something different on the DS-2054 form. On the ESTA site it does classify it further now though (it didn't back then I don't think) as -

"

Answer ”No” if:

(a) You currently have no physical or mental disorders; or

(b) You have or had a physical or mental disorder without associated behavior that may pose or has posed a threat to your property, safety or welfare of that of others; or

© You currently have a physical or mental disorder with associated behavior, but that behavior has not posed, does not currently pose nor will pose a threat to your property, safety or welfare or that of others; or

(d) You had a physical or mental disorder with associated behavior that posed a threat to your property, safety or welfare or that of others, but that behavior is unlikely to recur."

Which was the case at the time. I don't think I had anything, although if they wanted to nit pick, it could be classed as "You have or had a mental disorder without associated behaviour.." etc.

QueenofBlades, I'm afraid I can't give you any advice but I am interested to hear peoples thoughts on that.

I also have a question, as I'm REALLY confused about the Evidence of Support... the Embassy website says, on the interview document checklist page:

"Evidence of Support (Affidavit of Support): All applicants are requried to establish that s/he will not become a public charge in the United States. Please note that this evidence must be less than one (1) year old when presented at the visa interview. Please follow this link for more information. "

And upon clicking that link I see something about the I-864, but for family and employment visas, then:

" All other applicants must show evidence that they are not likely to become public charges while in the United States. Use of the form I-134is an efficient way to provide this information to the Consular Officer."

So does that mean I have to fill out I-134 and take it to the interview? And then when I do adjustment of status my fiancé submits the I-864? Or my fiance does the I-134 now and mails it to me?

None of the instructions he received in the mail told him to fill out either of those forms yet, so we're confused!

The Affidavit of Support is on the list of required documents you have to take to interview. It's poorly worded, I agree.

For the K1 interview, you must take the I-134 and supporting documentation (London would like to see tax returns, but a job letter / paystubs are also sufficient, the burden of evidence is less severe for this form) in person (as the visa applicant). This is the form the USC completes to show that they'll have enough money to sponsor the fiancé (or else they use a joint sponsor). Your American fiancé should complete it and mail it to you, with the supporting evidence, as it'll need a wet signature.

For the AoS, the sponsor (by then, your American spouse) does the I-864 with supporting documentation (tax returns). You can worry about that form later. smile.png

The I-134 info is also in the very first post on this thread: http://www.visajourney.com/forums/topic/350185-london-2012-k1s-from-noa2-to-interview-thread/?p=5135804 You may want to go back to the start and do some more reading.

There is no preference over how the fiancé shows income, as long as the officer is satisfied the immigrant will not become a public charge. A tax return is an easy way to show sufficient income, but an employer letter would do equally well.

For the AoS, the sponsor (by then, your American spouse) does the I-864 with supporting documentation (tax returns).

Agree. A tax return is mandatory or a valid reason why the spouse was not required to file.

You may want to go back to the start and do some more reading.

Brilliant idea. :)

WHAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAT? I only just had my medical yesterday?!?! OMG

And about the earlier post, I think I am over worrying too much. Even if I re-did my ESTA when I entered the US last time or now even, the answer would have still been "no" going from their guidelines on the website and on the DoS site. So it wouldn't have made any difference.

Does this mean the US Embassy have received my medical results now? I didn't think they scheduled appointments unless they had forms and medical results.

omg - that's awesome Queen! Congrats! :) I guess they received all your forms?

Even though our forms were signed for on 7/29, they hadn't logged them in yet as of yesterday although they did log the medical results...going to try today and see and then our congressman's office will write them back and say - you have it all, when can we have the interview. hopefully that's today they tell us they are in the system. :)

Hiya, I had the same question when I got my letter! Nich-Nick kindly replied with this to me;

'Your NOA2 hard copy has an expiration date on it, which is four months after approval (NOA2). If you don't get an interview before that date, the American needs to let the embassy know he/she is still on board by writing an updated letter of Intent to marry the beneficiary within 90 days of entry on a K1 visa. And get it notarized and mailed to the beneficiary to take to the interview. It can be exactly like the petition letter of intent, but addressed to London Embassy and have a current date.

NOA2 date + 4 months is your deadline for interview without a new letter of intent.

After that, new notarized letter.'

It helped me understand! Hope it helps :)
