Hi,

is it possible to retroactively file more evidence? I just sent copy of my marriage certificate (not notarized) with I-130 to CSC.

Can I now send in more evidence like pictures, third party affidavit of bona fide continual marriage etc before I get a RFE ?

That will definitely save me some time on already backed-up CSC on my I-130 leading to CR1 (as I am married for 7 months now).

If I can, how?

Thanks.

You should not send anything Extra until you get an RFE, if you get one.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Looks like you are going to gather everything and wait for RFE. You need to include the original RFE letter with your evidence package.

Sending items to USCIS unsolicited at this juncture will probably be an exercise in futility as it is unlikely anything you send would get matched with the file.

Dear M_Kamal, Yes. Just sit tight. I know I shouldn't be asking this but did you not read the instructions on I-130 as it clearly states the requirements? If you did and sent the minimum, you are in good shape and just cross your fingers. I don't think anyone can say for certainty who may or may not get a RFE. The chances may go up and down with supporing docs but the documents you referred will creat additional noise and they may ask for further evidence and you will be back to square one. If you didn't read the instruction, that would mean you took this too lightly; but regardless there isn't much you should do at this moment.

My suggestion would be like the others. Gather all the documents, and keep them with you. IF you get an RFE, you have them all, And if you don't get or and your NOA2 gets approved great, start dancing but you will still need them for your IV application. Read the requirements for AOS an IV and start collecting all the evidence/documents in advance, originals where required and copies that would be helpful. If documents are foreign, make sure they are notarized and if possible attested by the ministry of foreign affairs. The only way you can save time is where the preparation is on your end. If your are delayed by either USCIS or NVC there is little you can do as it will take their own course and due time; however you can save months of time by preparing in advance.

Good luck and best wishes for you both.

Thank you all. I guess I wait.

Btw @hellraiser, I didnot know of VJ before so I contacted a family member and all he said was to submit official papers (he filed for CR1). I didnot know affidavits and photographs / phone logs / airlines tickets are official papers like marriage certificate. Certainly my fault, I am not trying to put the blame on somebody else (I guess my relative was lucky). Now I am at VJ, I can be ready for future RFE (and/or NVC/consulate steps from the guides).

Thanks.

You got me wrong M_Kamal. I wasn't referring to anything on Visa Journey, rather the form you get from the USCIS site. If you submitted the forms, then you must have seen the instructions. And if you followed the required documents from the instruction, you would be all set. For the I-130 approval, you will find the mandatory documents (your certificate of birth if born in usa, naturalization certificate, passport) to prove your citizenship and some supporting docs to prove the marriage. Now you can't send all that are in the list, specially when your marriage took place intercontintally. For myself, I sent the marriage certitificate, passport size photo, G-325A, and the affidavits from relatives and that was all. It took 6 months for me to get NOA2 approval without any RFE, however, I've seen people getting out in less than 4 months. My point is, what took that long for my case, only god and USCIS knows. As you are in VJ already, try to find out what all documents you will need for IV and AOS and start collecting them as some of them take time. If you get an RFE, deal with it then and it's too late for you to send supporting documents and than MAY (again MAY) ring a bell to ask for more.

You shouldn't be worried at all. I only sent in specifically what was asked for and got approved. I've been under the impression stuff like emails, plane tickets, phone logs are things the beneficiary needs to bring to the interview to show proof of the relationship.
