I-864 Affidavit of Support Question

This is by far the most confusing part of AOS i think, lol. We also used a co sponsor (mother in law). We only ordered her most recent year of tax transcript to send with the AOS. It is not required to send all three most recent years tax transcripts but you do still have to write down on the I-864 what his income was for the last three years.

Ahh that's so helpful... thank you (phew, I ordered the recent one about 5 days ago, and was worried I would have to wait another 5-10 days), I really wanna get all this off for peace of mind!

I'm still confused now whether or not it's JUST okay for my wife and my father-in-law will file an I-864, or if my mother-in-law who lives with my sponsor will need to fill in an I-864A.. Question 24 seems to imply I will purely because she is part of the household of my co-sponsor.

Just to note again, I live alone with my wife, my father-in-law (my sponsor) lives alone with my mother-in-law.. he has no other dependents.

No, she won't need to file the I-864A. I'm not really sure how to explain, but as she's not your sponsor, she doesn't need to fill anything out.

Ahh, well that's good then.. less to worry about.. would you be able to tell me how I fill in Question 24 on the I-864 for my co-sponsor?

Okay, just had to look that up, lol. So, For 24a, you write the that you wrote on line 23. And that's it, no one is filing an I864A so that's it

So I just write in my father-in-law's individual income in 24a, then leave 24b blank (none), and do not check anything for 24d and 24e?

I think I'm getting it... no my wife lives with me, my father-in-law lives in a different house with my mother-in-law.

So does that mean my mother-in-law does NOT need to fill in an I-864A? If that is the case what will I put on my father-in-law's I-864 for 24B, do I just write nothing in there? It seems confusing because it talks about household income, is that TOTAL (including that I'm not using as part of the co-sponsorship) or is that just talking about the income being used in the co-sponsorship?

Ah more questions for the I-864 for my father-in-law (co-sponsor).

Am I included in the 'household size' even though I do not live with them? More specifically I have entered '1' into 21a, b and c, so does that make the total for 21h '3', even though I don't live with them?

Your father in laws household size will consist of him, you and his wife. Spouses are always counted even if they're not dependant and you are counted as you are the one being sponsored. So, if there is no other dependants then the household size is three.

You do not need to include MIL unless her income is necessary to meet the poverty guidelines. She does not need to fill out the I-864A if you aren't using her as a cosponsor.

That's so perfect, thank you.. I think I understand it now.. the only I-864s will be from my wife (even though she doesn't have an income) and will mark "A" for question 1 and my father-in-law who will answer "D" for question one.. no other I-864's or I-864A's..
