Hi guys..my I-94 will expire this coming week and we will just be about ready to file for the AOS. Anyone who had a problem with their AOS when I-94 is expired upon submission? Just FMI, I got married already Dec. 2011 and I-94 expires Feb 2012...thanks VJ's

Doesn't matter if the I-94 expires, you already married in the 90 days that is the only requirement. Just send the AOS in as soon as you can.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

The answer is no.

Answers differ from time to time..hence there was a dispute between the role of the I-94's expiration date whether or not it should be the basis of doing the AOS or only in relation to the time when to get married. USCIS is not as clear in giving info..and upon reading experiences..you get different answer..had my post been redundant, I give the moderator the decision to close or delete this..sorry if this bothers you but AOS is a big deal for me so I asked suggestions from here which is up to date.

There is no dispute when it comes to the I-94 rules in relation to the K1. I-94 is ONLY to get married. If it's another visa or the VWP then the answers changes. The K1 is special.
