Tired Waiting for I 130 and I 129F

Okay I am from Texas and married my wife in Honduras in May of 2011. I130 was filed and I got a notice of reciept via the I 797C August 25,2011. Then I filed the I 129F and got the I 797C for that on Sept. 8,2011. I followed the instructions from USCIS and now I see from another post that this may all be wasted time. I guess I need to study up on CR1 stuff. If anyone has advice, please feel free to give guidance. I am here now in Honduras for 20 days. It will be 5 months from the 129F on Feb 8 and I am tired of waiting. I am now thinking of hiring a Coyote to smuggle my wife and worry about all this other ####### later. I have all my paperwork, copys and info here with me.I dont remember where I sent this paperwork. Wherever the instructions said to send. I know that both my 797C came from California Service Center................

You want to smuggle your wife illegally, which will give her a ban to the US, no ability to become a resident, when there is a clear legal path available to you? And you've already done most of the waiting?

Talking about smuggling your wife into the USA on an open forum where USCIS and US embassy employees check from time to time is a bad idea.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

But why did you do a I-129F if you was already married? Don't get it? The I-130 should have been enough? check the # on the I797 for the I130 and check the status of that application on the uscis web site. Maybe you are already approved and don't even know it.

Only thinking out loud, no crime in that. So would it be possible to go and file the DS230 and DS3032 at the embassy here? I have checked the USCIS website for approval every day and its not approved yet. Over 5 months now on the I 130 so I guess I could call and inquire. I filed the I 129F becuase I thought thats what I was supposed to do. Too much conflicting info to dig through here and on the USCIS site is confusing.

no, these forms are not filed there UNLESS you have a successful NVC expedite in place, pursing a CR-1 visa. Well, at least the DS-230. The DS-3032 isn't even used by the Embassy IV unit - that's an NVC specific form, for NVC document intake. If it's a K-3 visa - the DS-230 is sent off to the IV unit after Packet 3 arrives to the Foreign Spouse.

Coming up soon, instead, I'm guessing you'll need to do intake at NVC for the CR-1 visa, unless by some stroke of God the I-129F is actually forwarded on by NVC. Mostly, that doesn't happen.

So, whilst yer there, with her, have her sign the DS-230 and DS-3032.

Okay I have read through the NVC Shortcut, thanks so much for the info. I have all the necessary documents for that. I am only confused on one part of that process --- The DS230 packet is sent to USCIS or have an appointment at the Embassy to submit?????

Once USCIS has approved your petition, you'll have no more dealings with them regarding obtaining the visa. Everything after petition approval is with NVC or the Consulate.

Facts are cheap...knowing how to use them is precious...

I'm sorry, there are 2 different forms intake processes,

depending on which Visa yer chasing after.

Each is different, after USCIS.

A K-3 visa has forms intake at the Embassy IV unit.

A CR-1/IR-1 visa has forms intake at NVC.

Once you can decide which visa you are chasing after, I sense you can stay on 'that' path - whichever you choose or is chosen for you .

The waiting Totally SUCKS.. I understand you.....my husband is in Honduras right now.. his been there since July 2011 and we are waiting now for approval for the i 601 hardship... its takes time.. BUt the waiting will be worth it in the end

The waiting Totally SUCKS.. I understand you.....my husband is in Honduras right now.. his been there since July 2011 and we are waiting now for approval for the i 601 hardship... its takes time.. BUt the waiting will be worth it in the end

I was told today by an immigration attorney that filing a DS-230 on top of all this would not do any good. She advised me to contact my Senator. Its been over 6 months since filing the I-130 so I guess I will try that..........

Its totally worth the wait to see your wife with her passport, visa, and smile. I waited two years, lots of pain and money, and tomorrow we are going to open his bank account and his cell phone will be in his own name! Priceless!
