Timeline

Fellow members. Myself and M????????? financee are really depresed and can not hold backs tears. We had our 2nd interview today we had lot of more evidence beside the one presented for 1st interview new pictures over 15o with other people in it. Emails chat' call log, greating cards. Question asked : how do we meet, marriage plan and how many kids we plan ???? have. She asked last time we saw each other she told her that iam outside and she answer all other question. ????? guess the co did not confused that iam relatioship is real because she was concern that we have same last name and from same state is the main reason for our visa denial pls advise we are confused about what ???? do next

Sorry for your disappointment. I can't imagine why having the same name would be a problem. I'm not sure if K1's have to send a copy of your birth certificate, but with the I130 the petitioner is suppose to give a copy of their's and you can clearly see you weren't born to the same parents. Perhaps you should get a copy of your long birth cert., to prove there is no relation.

Did you provide proof that you are not related? birth certificates showing different parents - blood test showing not related etc.

make an appointment to see someone at the consulate before you return( go with proofs). They have days that Citizens and permanent residents can do walk in or did that change? Try to talk to someone there before they start the process of sending back your file to USCIS. call your congress person while you are in Nigeria. That way you are present to defend anything before you return.

Relationship for immigration purposes is different than claiming to be relatives in a fake relationship. The second if they give you a lifetime ban for. It sounds more like they think you didn't provide enough proof that you have a maritial relationship and the USC is helong someone from "home" get to the US. Did you meet when young or as adults ? How far apart were your villages ? If you have a common last name like Sule then they have to know that. You need to have absolute proof of your relationship.

Being related of course is a redflag but not a cause for a denial. My fiance and I were approved and we are third cousins. The fact is we never hide it. We put it in every single document that ask about (I129 has a question that ask if you are related to your fiance and please and what kind) We could hide it cause he is blond caucasian blue eye man (really really tall), and Im a dark hair,dark skin, and brown eye woman. We don't share any of our last names, neither our mothers. But we rather to say the truth. In your case MAYBE, they thought that you were related but you hide the information. I saw a xtreamly similar case. A couple in the Domenican Republic. Here in Latin american we used 2 last names (dad's and mom's) and they shared the last one just for coincidence. The CO from Domenican Republica was pretty upset cause he thought they were hiding the fact and they weren't related AT ALL. They had a second interview where they brought birth certificates from they parents and grandparents but didn't work. I guess they don't care if you are related as long you don't lie to them and have enough proof that says you are really in a relationship, cause weddings between second, third, fourth whatever, are legal not only in the US but also everywhere.

I know is not your case, but maybe here is the problem. Try to contact your congressman. I wish you the BEST and don't lose hope. Remember that is God who has the last word in EVERYTHING.

in our case we were put under AP because one of the reason was that he and my mom had the same last name. i was phone interviewed 3 times by them and each of those interviews they kept asking if we were related and if his family and my mom's family knew each other. his last name was the same as my mom.
