Thanks for the answer! Yes all his income for 2011 was earned abroad and will be excluded.

We'll also start filing jointly for 2012.

NRA means Non Resident Alien, right?

Yes, that's correct. I filed "married filing separately" as well. I had to print it out and write in NRA because it doesn't allow you to type in a non-number in the SSN field but that's not a big problem.

People i am so happy i just got off the phone with NVC, they told me the money has been cleared and that my documents ( IV package ) are correct and all that they need now is the AOS. they also told me that our joint sponsor need an employment letter as my wife ( the sponsor ) will submit an employment letter as well. They said all that the petitionner is submitting, the joint sponsor will have to submit them as well. I am so happy that the money is cleared, no RFE as we feared.

Saylin, a quick question. I was checking Ling Che's NVC shortcuts, and from what I understand, the order is as follows.

1. Petitioner pays the AOS fee.

2. Beneficiary sends in the DS-3032.

3. Petitioner sends in the AOS package.

4. Petitioner pays the IV fee.

4. Petitioner sends in the IV packet.

Is that how it works???

Another quick question. When my husband files his taxes this year, is it possible to include my name in there?

Like foobaz already said, they're two different tracks that run parallel to each other.

Mostly.. but it would be more like this:

AOS Track:

1. AOS Fee Invoice and DS-3032 are generated and sent out

2. AOS Fee paid, DS-3032 Returned

3. AOS Package sent once the website shows a PAID status

IV Track:

1. IV invoice is generated

2. IV Fee paid

3. IV Package sent once the website shows a PAID status

I'm leaving out the details over precisely what causes each invoice to be generated. The important thing to know is that they are two separate tracks and not a strict sequence. They can and often do happen in parallel.

Everything's right EXCEPT, the DS-3032 is part of the IV track, not the AOS track. Acceptance of the DS-3032 triggers the IV bill being invoiced.

Haha, you don't know how true that statement is. Last year one of my packages arrived soaking wet after having fallen off the boat into the river.

I talked to the guy at the post office today and his only response was, "wow, that's really taking a long time. Well maybe it'll get there this week." Thanks for the help...

Wow, you're kidding me... Maybe you should put your packages into waterproof envelopes blink.gif

Oh no!!!

I called the automated phone system to check my status, and it said that they recieved my packet but found that information was missing or incomplete. It said that I would recieve something stating the details of what was missing.

How do you mean NVC???? :crying:

Don't worry! It's more than likely this is just a false checklist! I'm betting they reviewed one of your packages and are now requesting for the other one! Even though it's in the building, they don't bother checking, and most of the time issue that AVR message automatically. Call an operator to confirm this.

For anyone who used the I-864EZ, in the section where you calculate the number of dependents did you zero out all the spots that didn't apply or did you leave them blank?

I put zeros. Didn't want to get a checklist saying I hadn't filled everything out headbonk.gif

He tells me that there's a field where he's supposed to include my SSN, which of course I don't have yet. Do I need an ITIN? I thought it was only needed for married filing jointly??

My tax preparer said that we needed an ITIN for married filing separately, but 1. that was so I could claim my husband as an extra exemption, and 2. she didn't really know much about filing while in our situation. I had to force her to file married jointly for us and exclude my husband's income by sending her links from the IRS webpage that says that's exactly what you're supposed to do. Five trips to the tax office before she got it right. sigh.

Oh no!!!

I got the same thing after submitting my documents. It definitely could be a false alarm!

That's my thought on the subject. Seems odd to zero out the spouse line when you're applying for your spouse, no?

Hi guys!

Foobaz, it's coming this time! The termination message seems to be very good news these days

I have a tax question here: we decided that my husband was gonna file "married filing separately", I've been pushing him to file before the interview. He tells me that there's a field where he's supposed to include my SSN, which of course I don't have yet. Do I need an ITIN? I thought it was only needed for married filing jointly??

I filed Married - Filining Jointly. To do this you have to fill out a form W-7 (application for ITIN) and attach it to the income tax form. You have to send them together. Leave the section for social security number of spouse blank, the IRS will put the ITIN in when they review the W-7 and file the income tax return.

w00t... NVC says I'm now fully EP converted (or in reality, they converted me Thursday/Friday and not for the whole of the last two weeks) and will be sending out the DS-3032/AOS invoice. :)

Addendum: It may be wise in the future for people to immediately call when the payment portal gives the false "This case is in the process of termination." message. If it is true that is the indication that manual data entry is complete, the AOS/DS-3032 could be immediately generated so why wait to call?
