Oh No. I got a checklist from NVC, requesting for my Original Marriage Certificate, it was included in the package. When I called them they say it has to come from the "Government Registrar of Marriages from India" Whaat!? What do they mean? We got it from our state registrar's office. I can't beleive this.

NVC is a little obnoxious with civil documents, and you have to send them EXACTLY what they want, or they'll reject it. You have to look at the DOS website, list of country document (http://travel.state.gov/visa/fees/fees_5455.html?cid=9215#docs), and get one that fits perfectly with their description:

"Marriage Certificates

Available. The Hindu and Muslim communities do not usually register marriages, however, marriages by Hindus, Buddhists, Jains or Sikhs may be voluntarily registered under the Hindu Marriage Act of l955. This Act does not apply to Muslims, Parsis, Jews or Christians, who may register their marriages under the Special Marriage Act of l954, or the Christian Marriage Act. Marriage certificates for marriages registered under these Acts may be obtained from the offices of Government Registrar of Marriages, which are located in the headquarters of each district. The certificate will be issued by the Registrar only if the bride and groom personally appear before the official and pay the required fee.

A certificate of marriage between Muslims is usually issued by the priest who performed the ceremony. The document is in the Urdu language, and a certified translation is required. Marriages between Christians are usually obtainable from Church records. If the marriage has not been officially registered, then two sworn affidavits giving the names, dates and places of birth of the bride and groom, and the date and place of marriage, as well as the names of the parents of both parties are acceptable. The affidavits must be executed by one of the parents of each party, or if the parents are deceased, by the nearest relative of each party who was present at the wedding.

Note: A document termed as "Marriage Agreement" or "Deed of Marriage" to live as man and wife (under the Registration Act of l908) is not confirmation of a marriage solemnized legally under the Indian Marriage Acts now in force. Such a document does not confer upon the contracting parties' legal marital status under the law."

Quite complicated actually!!

Well if you're sure that what you sent is what they ask for, then call and request a supervisor review of the document.

Saylin, from what I understand, you're probably the best bet to answer this question. Please help.

The I-864 EZ can be used if you do not require a joint sponsor and qualify completely on income alone (no assets). If those are both true, you can use the EZ version which is much simpler to complete.

I-864EZ can be used if you are able to answer yes to the following:

  1. You are the petitioner
  2. You are only using income to meet the requirement
  3. The sponsored person is the only person immigrating on the underlying petition

When I submitted the AOS to the NVC, I used the I-864EZ.

Ok thank you so much my friend. I still have a concern. My wife job main office scanned her letter of employment and emailed it to her. We were hoping to receive it in the mail as previously informed, but that is not what happened. Can we print it and send it to NVC, will they take scanner letter of employment into account?

I'm not sure. I submitted my husband's original to NVC as it had a signature. You can always try with the original. They might accept it since the employment letter itself is optional for the AOS package.

Yes, look at what Ryan said as you have to qualify for 3 things to be eligible. In our case, we were so we used it as it was a much shorter form than I-864.

No need to ask twice. Some people do go to sleep and only read questions upon waking up. Remember, we're all in different time zones and you should always give at least 12 hours before expecting a response.

So you are telling me that you can have a joint sponsor when you use the I-864EZ?

That, my good sir, is incorrect and I believe you misread (or didn't read all) of what I wrote because I clearly wrote that you also must completely qualify on income alone.

I never wrote that not having a joint sponsor was the only condition for using the I-864 EZ and quoting me as if I did and then saying that I'm giving incorrect information is really bad form.

We do not have the original letter. It is in the main office, they should mail it to her house but she has not received it. As she was calling the office they scan it and send it to her email.

Qualifying on income alone means only using income, not a combination of income and assets. Furthermore, I read and re-read the I-864EZ instructions and nowhere in those instructions does it say if the petitioner requires a joint sponsor, the petitioner cannot use the EZ form (joint sponsors on the other hand cannot use the EZ form). I stand by the statement I made earlier.

I never wrote that not having a joint sponsor was the only condition for using the I-864 EZ and quoting me as if I did and then saying that I'm giving incorrect information is really bad form.

I singled out the one piece of your post that I was responding to and responded accordingly.

Gents, you're both correct you just said it differently.

Who May Use Form I-864EZ?

You may use Form I-864EZ IF ALL the following conditions

1. You are the person who filed or is filing the Form I-130,Petition for Alien Relative, for a relative being sponsored;

2. The relative you are sponsoring is the only person listed on the Form I-130 petition;

3. The income you are using to qualify is based entirely on your salary or pension and is shown on one or more Forms W-2 provided by your employer(s) or former employer(s).

Who May Not Use Form I-864EZ?

1.The relative you are sponsoring is not the only person immigrating based upon the underlying visa petition;

2. You filed or are filing a Form I-140, Immigrant Petition for Alien Worker, for the immigrant you are sponsoring;

3. You are a joint sponsor;

4.You are a "substitute sponsor" filing because the originalI-130 petitioner is deceased.

So you are telling me that you can have a joint sponsor when you use the I-864EZ?

You can HAVE a joint sponsor and still fill out the EZ form as the petitioner (that's what I did, with no problems at NVC). You can't BE the joint sponsor and fill out the EZ form.
