Oh ok then it is not gonna be a problem, it is in french and creole( both our language). The only thing now is that RFE. At NVC, if there is a RFE, they email you about it and give you the detaild? For uscis, they notify u on their web and advise you to wait the hard copy to see what it is about

Yes, they call it a "checklist", and they send it by email.

CR1 Visa

04/08/24: interview scheduled for 05/14. Received "We have taken an action in your case" email.

05/14/24: approved at interview, same-day oath ceremony in San Francisco 🥳 🇺🇸

06/10/24: application submitted at post office for passport book and card, paid for expedited processing and shipping

06/24/24: received email notification that passport was approved, then shipped with tracking number

:blink: Yeah that's stupid... You sent your W2s too? Because the affidavit of support form specifically gives you the option of sending the 1040s + W2s OR the tax transcripts.

That said, I'm sure you're not the only one it happened too, because it says all over the guides here on VJ that transcripts are the "preferred" evidence.

Yeah, I sent everything! I wanted to get my tax transcripts but I was having problems obtaining them. Every time I tried to order them online, I was told my SSN didn't exist. And it was literally impossible to talk to a real person at IRS. So after I got this wonderful checklist, I had to trek downtown to my local IRS office (*shudders*) to be told I haven't filed any returns by the receptionist! I lost it and was nearly kicked out of there by security. Waited over an hour to talk to a person. She had trouble finding it as well. After a few calls to 'headquarters' she managed to print out this old looking tax file transcript. No header no footer--it looked like I could have done this at home. I commented on this and she stamps them with 'Received by IRS'. Whatever. Better be good enough for the NVC.

I think I may also send a copy of my sponsor's passport. I forgot to include it with the AOS paperwork. They haven't asked for it, but technically it should be there. Will this just confuse them?

I didn t write the case number on the back of my photo, this will surely result to a RFE

Not writing the case number on the back of the photo in of itself will not generate a checklist. A scenario that would result in a checklist would be if the photo were to become dislodged from the file, if it did not have a case number on it and it was found, personnel would not know which file to put it with.

Unfortunately, I forgot the declaration letter... :bonk:

I'm calling the IRS now to see if it really is necessary or if the W-7 by itself will do the job. Worse case, the wife will have to send me another over night package. At least it isn't terribly expensive from China! :lol:

We included the declaration letter when we submitted the big tax return thingie with the W-7 application. There's a topic on this in the China forum - several of us outlined the steps we took and the results.

Yeah the actual transcripts look like you could have done them yourself. Whatever...

We're lucky we were able to get them here in France I guess. Well, the 1st time we ordered them by phone and they made a mistake (sent 2 return transcripts, but for the last year an account transcript, which is something different). Had to order online another time.

For the copy of the passport photo page, I don't know really. I guess since what you're gonna be sending is part of the same AOS package, it would be ok, but I'm not sure. I hope Saylin will show up and answer you.

Completely agree. An agent told me that preparers don't understand how to file married,if the spouse is overseas. Most preparers don't know about the W-7, or ITIN number because they see it so infrequently. They're telling people to do that, because they don't want to say, "I don't know". But if you are married, and file single, like Foobaz said, it could look suspicious to the VO.

Ya, most tax preparers are only interested in the fees they generate.

Unfortunately, to do a 'first filing' as MFJ with a W-7 application form - requires that all is done via paper, sent off to that special ITIN intake address in Austin, TX. Is no concept of 'electronic filing' here - but it is possible for the refund to come in via ACH/direct deposit into a bank.

Most 'tax professionals' not know of this.

NVC ain't ready for your casefile processing, yet. When the USCitizen petitioner recieves the AOS FEE BILL via email, then NVC is ready, and waiting. Prior? Not so much.

Rujby, don't worry about this, by the time you get a RFE for not writing your name and case no. you'll be sending your AOS package. So if you do get a RFE think that you're sending the AOS and IV at the same time. At least by then you'll know if there's anything else missing. So technically you didn't cause a delay since you haven't sent your AOS.
