Hopefully that answer satisfies them. :)

For the benefit of anyone else who reads this thread later... Never file taxes as Single if you're married and trying to get a visa for your spouse. It looks terrible to the VO.

If someone else is preparing your taxes and they try and insist that you have to file single, tell them to pound sand and find someone else to do your taxes.

The proper process is to file as either Married Jointly, or Married Separately, and attach a W-7 to get an ITIN.

Completely agree. An agent told me that preparers don't understand how to file married,if the spouse is overseas. Most preparers don't know about the W-7, or ITIN number because they see it so infrequently. They're telling people to do that, because they don't want to say, "I don't know". But if you are married, and file single, like Foobaz said, it could look suspicious to the VO.

Timeline

Well some stuff is gonna happen before that.

First, they'll review your packages, and if everything is ok accept them.

Then, you'll have a case complete, and be in queue for interview scheduling

Some time after that (it can take a while), your interview will be scheduled and you'll receive an interview letter by email

Only then, they'll transfer your case to the embassy.

You can start calling by Wednesday to know if the packages are under review yet!

Great! Thank you. I will start calling Wednesday. After a three day weekend the NVC staff will be eager to start on the new arrivals. fingers crossed

Regarding amending, i would like to know also. Maybe we just file 1040 w/ both spouses signature on it.

I'm gonna go to my that Tax service place and ask them how to amend the single tax i filed with them last week.

and follow this guide (which i read before doing this, just didn't know it has potential to cause issue during interview)

Can someone verify the below steps to file Married Filing Jointly?

Email 1, 2, 3 to spouse to get their signature, and mail back to me (USC)

1) 1040 filing married jointly

2) W-7

3) declaration letter (6013(g) letter)?

is this the letter name 6013(g)? just wanna know the template

Also the spouse has to mail back:

4) Notorised passport of NRA

Once i get all 4 documents from my spouse, myself sign 1040 and

Mail all 4 to :

Internal Revenue Service

Yes, that's it. The declaration letter is correct too, I typed one instead of using this one.

It is a good idea to go back to the Tax Preparer that did your taxes, remember there are some "Acceptance Agents" too. You can look them up irs.gov that can help you.

All that is correct, but for the passport I brought it back with me and had a copy notarized in the states. It was easiest for me, instead of going all the way to Santo Domingo and have it notarized in the Consulate there. For the Declaration page, I just wrote a couple of lines saying i'm a usc and my wife was a non-resident for on the last day of 2011, and we would like her to be treated as a resident for tax purposes for the entire year. Something like that, and we both signed it. Don't know about any template. Someone else will have to tell you how to amend, not to clear on that process. I have an idea since I had past taxes looked at by other preparers but those were simple, this is something different and don't want to spread false info.

Yes, a acceptance agent looked at mine. But he told me that an Acceptance Agent cannot give an ITIN number. What an Acceptance agent does is basically what the person who receives your W-7 and other forms do. He reviews your file, looks over the ID and paperwork, and fills out a form saying everything is good, and whoever receives your Taxes in Austin can just go ahead and process without going over your file himself. You still have to send you forms to austin, even with an Acceptance agent. This was the info i got from the agent in Boston and he's the one who looked over my paperwork. I wrote his name on another post, but he is listed as an certified Acceptance agent on the list floating around on this site.

It does look good...I said something like...

"I am electing to be treated as a resident alien for tax purposes only." It wrote about 2 to 3 sentences, that included our names and the tax year (2011). The important part here is that your spouse wants to be treated as a resident alien for tax purpose.

Hi All,

I just got my NVC Case # on the AVR and spoke to an operator who gave me the Invoice ID #.

I went into the online payment system to try and pay my AOS Bill using the Case# and IIN, but got an error saying the following:

This case is in the process of termination. Fee payments and online forms can no longer be accepted. If you believe you have received this message in error, or to resume processing of the case, please

contact the NVC

immediately.



Does anyone know why I am getting this? Is this because my case has just been entered to the NVC system and it's not ready for accepting payments and such?

The message is rather scary :(

11/10/2011---- NOA1 email received

11/14/2011---- Touched

1/4/2012 ------ RFE ( Request for Evidence ) email received

1/13/2012------ RFE document mailed to USCIS

1/25/2012------ NOA2 APPROVED ( Yahoooooooo )

NVC Stage

1/31/2012-------Case received at NVC

2/08/2012------- Case number received, IIN, both petitionner and benificiary email given

2/08/2012------- DS 3032 ( choice of agent ) emailed to NVC

2/10/2012------- AOS fee bill paid ( status: in progress)

2/13/2012--------DS 3032 accepted

2/14/2012-------- AOS fee bill shows " PAID" and IV fee bill invoiced

2/16/2012-------- IV fee bill shows " PAID"

2/17/2012-------- IV package sent via USPS

2/24/2012-------- IV package reviewed and accepted

3/27/2012-------- AOS checklist express mailed via USPS

3/28/2012-------- AOS Checklist received by NVC

3/30/2012-------- Case Complete ( Thank you Lord )

Medical / Consulate / POE

5/11/2012-------- Medical Exam

6/12/2012-------- Interview date / APPROVED

6/21/2012 -------- POE Newark, NJ

I got that one too before they generated my fees

April 2007- Met while I was in sophomore year in high school by his house

December 16th 2010- engaged

May 28th 2011- married in Sāo Paulo<3 <3

July 13th- Sent I-130

July 15th- I-130 received

July 18th- received NOA1

August 1st - touched

Sept....Oct..Nov...Dec...Waiting -__-

January 24th- received NOA2 via email

January 27th- recieved NOA2 hardcopy

February 1st- NVC received

February 7th- got my case number

February 7th- got the IIN number

February 10th- payed AOS fee

February 14th- AOS PAID!

February 15th- payed IV fee

February 16th- IV PAID!

February 23rd- sent AOS & IV packages to NVC

February 24th- packages delivered at NVC

February 29th- recieved checklist

March 5th- sent back checklist items

April 30th - interview

I got that one too before they generated my fees

I think that bouerchithi case is more complicated. The word of termination is scary and they do not want to take the fee payment from him/her

Matt pushbrk just replied to my post he said it is not gonna cause a problem because him and some members was in the same situation they just amend it once the spouse arrive the us which makes us happy :dance:

But PUSHBRK does say correct way is to do it Married filing jointly.
