Hello again fellow members,

Now i have mixed questions and i hope this won't bother u. Ive been married for almost 5 yrs now to a US citizen.I am getting ready for my N-400 based on a marriafe to a US citizen.

I have other posts but i will just do it all in once here (please bear with me).

Here are my concerns:.

We filed as married joint in our income tax since 2007(when we got married). Since hubby has been unemployed for almost 3 yrs.now we decided that i will have to file this year which i just did as married filing separately.Reason is he owes child support from his ex. So this time i filed separately but NOT Head of the household.

1. Would it not cause red flag in my N-400 application?

I read that ur co-sponsor once she will change her address will also have to file an AR11?(change of address) ? I did not know that and it's been a year since my co sponsor for my kid's I-130 bought her a new house and i did not file the AR11 coz i did not know i have to.

2. Whos gonna file the AR11?/ IS it me or my sis in law who was our co-sponsor?Am i gona be in trouble for not filing the AR11 for my co -sponsor??

My husband is out of work since May 2009..would it be a problem if i send in my N-400 application? I am working full time since 2009 so am the only one bringing income in the household.

3. Would it be a problem with him being unemployed?

4. So should i send the Tax transcript for 2008, 2009 and 2010 when i do my N 400 or should i include my 2011 as well?

Please help i am really confused now. Thank u so much.

No worries.

1. See my answer at 4 as well. If you do not send them your 2011 return that you file separately, it will not cause a red flag.

2. Whatever the co-sponsor does is up to them, that is not your responsibility for as far as I know. They made that 'contract' with the government themselves, you just submitted the co-sponsor paper. I don't even have contact with my co-sponsors and they could have moved around the world 4 times and I wouldn't know. I wouldn't be worried about it if I were you :)

3. No, not at all. As long as he is no burden to the United States, they wouldn't give a darn thing if he works or not. How many people are not at home these days without a job, or simply a stay-at-home mom/dad without income? Again, as long as they are no burden to the US, the US doesn't really mind it. They might ask a question during the interview regarding that but they wont deny him based on that.

4. No need to send the 2011 now, they cannot request that one until after. If you have not filed it yet, you cannot send it either. This way you would avoid the filing separately part ;) For now, 2008, 2009 and 2010 will suffice.

12/14/11 - Sending out N400 package

12/19/11 - Received by USCIS

12/21/11 - NOA date

12/22/11 - Check cashed

12/27/11 - Received NOA

02/06/12 - Received yellow letter (pre-interview case file review)

03/13/12 - Placed in line for interview scheduling (3 yr anniversary)

03/17/12 - Received interview letter

04/17/12 - Interview - No decision, application under further review

04/17/12 - Biometrics

04/25/12 - Placed in line for oath scheduling (so I'm approved yay!)

04/27/12 - Received oath ceremony date

05/09/12 - Oath ceremony!!

Also note that a sponsor (or co-sponsor) would not file an AR-11, they would file an I-865. See my reply here.
