CONGRATS TO ALL TODAY :dance:

However, ours was denied with a chance to appeal, have no idea as to why yet all I know is that the officer tried and tried buy I guess his higher up said no. We yet have a long journey ahead of us but with hope and faith in front before anything else we will be together soon.

09/20/2011- Service Request

09/28/2011- Service Request Reply(extensive background check,allow 6 months...blah-blah..)

10/07/2011- RFE(4 pages)

11/15/2011- RFE reply sent back to USCIS

12/05/2011- reply for RFE showed up in the system (took them 20 days to locate and input in the system...lucky us...)

01/11/2012- NOA2(urrrrraaaaa!!!!)

NVC

01/23/2012-case received(took 12 days...waiting for the case #)

01/27/2012-case # received(but wrong Embassy assigned...has to change)

02/01/2012-invoices are e-mailed to both of us by NVC

02/07/2012-invoices are paid(had to wait due to the wrong assignment of the embassy )

02/14/2012-both packgs are sent in

02/29/2012-checklist for a missing copy of passport(not missing in reality,but either wait 20 days for a review or send it in again,so we sent it in...)

03/09/2012-case complete( could have taken less ,but well..who cares it is complete now!!!)

so sorry chula hope u guys can overturn this denial, I sent a letter of complaint to the General Consul and now when i call VS i am under AP i hope this is good i still have hope if not i would appeal and if that dont work i am just going to move overthere to be with him eventhough i will lose everything here in NY but at least i will be with the love of my life 4 ever :)

Thank you everyone, as y'all might figure my eyes look like cat eyes or like if I have just been punched on both eyes at the same time from so much crying today..

he completed his 10 year ban we thought we was free to go or at worst it would be a request for a waiver but nope, it's worse its a 212 a 2 c, and a 212a2aii, come to find out that one of them is a lifetime, for Lord only knows why. they told my husband that he would have to hire an attorney and appeal... my life just flipped, right now is not the time for us to think but at the same time I feel like if something is really wrong....

chula, i will be praying that you'll be reunited with your husband soon. there's still hope. i think a lawyer would really help you. we were denied visa before but my dad got us a lawyer. it took us some time to be reunited with my dad but we did it. fight for it! :)

Did they tell you how you can appeal? When and how are you supposed to learn the exact reasons for the denial?

I'm not mad at you, lol...

We do have a right for appeal for the 212a2aii, but we are not sure for the 212 a2c (which there is no waiver for) this is a lifetime bar, this really caught us off guard. Now what I'm going to do is write to the Embassy so that they can review this charge (don't even know how we is going to write this)but we are sure going to try, this was a charge of over 20 years ago that we did not even know he had, they say that he was trafficking drugs, well his stupidity was that back then he did a supposed favor for his supposed friend and my husband did not even know that he was being set up for this, so he picked up 2.8 gram of marijuana (which he didn't even know what it was) and gave it to his supposed friend and there was an officer waiting right there for him... go figure!!! so YES we do need a lawyer for this one, and hope that we can overturn this charge.

Chula ur best option is to contact ur Congressman first and see what they can do to help ur case and if they cannot do anything then u contact a lawyer but start off first by summitting a formal complaint letter to the General Consul and take it from there, this is going to be hard but u can overcome this never give up hope without at least fighting for whats yours.....:)
