I had DV lottery and then I became Permanent Resident on 1998. I’ve just renewed my GC last year. I want to apply for citizenship, but I have below situations:

I had open container in September, 2007 . I also had Domestic Violence summon. I went to the court for arraignment, but the victim didn’t show up. Therefore, the judge dismissed that case.

Now my question is, am I still qualify to apply for Citizenship? Any help would be appreciated.

No one can give you an answer. You have to report the arrest for domestic violence. You will need to provide proof that the case was dismissed. You may also be asked to explain the situation. Based on the specifics of your arrest, USCIS will make the call as to whether you meet the good character requirement for US citizenship. Even if you tell us the specifics, no one can tell you what USCIS will do - it's a judgment call based on the evidence that we don't have.

Thanks for the feedback AAron2020, I was never arrested in my life. In fact, I recieved a call from pricent to go their to collect my summon. I then went to pricent and cop handed over the family offense paper and told me to show the date that indicated on the summons. I was also told that if I didn't show up at the court , the cop then issue a arrest warant for me.

I went to the court, but the victim didn't show up. Judge then told me that since the victim was in there, then judge told me to go home.AAron2020, please post some feed beck. Thanks in advance.

The challenge is everyone has an unique situation, as such unless one is from that same exact situation can never give you an answer with proof or experience. However following instructions, reading rules, observing others experience and above all using common sense people try to help one another. I have seen many becoming a subject matter expert on many issues.

The two answers you got should be enough for you. Unless you were arrested and/or convicted I dont think you will fail the requirement. Even if you were arrested and was released without conviction and has proof for that, you may pass. Bottom line is this, provide all the information required and if you feel something may appear negative, have enough documentation and go for it. For someone to answer all your questions with certainty has to be summoned for domestic violence where the case was thrown by the judge because the victim failed to appear. I don't fit in this particular scenario and my suggestion is based on one document and common sense.

I wish I could give you more constructive and meaningful feedback.

Yeah, this country of ours is very strict on domestic violence, even if your spouse asks you a question, and you don't answer it in two seconds can claim you are ignoring her. See its okay in some cultures to claim a buddy had sex with your wife, bury her up to her neck and stone her to death. Not that way here. Seems like wife beating is common in Latin American countries. Wife was a victim of that, most she gets out of me is a tender pat on the butt.

Can even get into deep trouble if someone see you kick your dog. Think you will have a lot of explaining to do. But this country is not so kind to criminals or enemies. Can't believe the number of drug victims overcrowding our prisons. Just a few are speaking out, should be in rehabilitation, not prison.
