Can this be a mistake?

I live in Ghana and my huaband lives in the US. We married in Ghana and it's been 1 year since we got married.

My problem is after applying for I-130, we got I-797C NOA, then we filed for I-129F and got I-797C, then, my husband noticed a mistake about the address and my country of birth on the NOA1 on I-129F and called USCIS which they sent email saying they have corrected it. Now we got what surposed to be NOA2(approval) but it does not say approval but rather receipt notice and when we called the lady from USCIS says is just correction for NOA1 which we find hard to take in bcos it has Alien number and looks deferent from the first NOA1. has anybody experienced this before and what should we do since the lady from USCIS did not sound friendly and explain well. :unsure:

If the notice doesn't state that the petition has been approved, then it likely isn't an approval notice. From my experience with USCIS, everytime a petitioner/applicant changes an important info in their system, a notice is sent to that person (petitioner/applicant). I received a few of those in the past. However, none of them had an A# on it so ur situation might be unique. If I were u, I'd call the USCIS again and simply ask of the status of my petition. U could also go on uscis.gov and check the status of the application. If it has been approved, it'll be indicated there.

Pretty sure it's the receipt for change of address/correction. But yes call them and have them read to you the address they have on file(and country of birth) to make sure it's correct now. They don't email sensitive information. Has your most recent receipt got a case number, and if so, does it match with the petition you corrected the info on?

NOAs are just a term used here. NOA2 could be an RFE which would turn the approval into a NOA3 I hardly see anyone calling it that.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

Why did you file an I-129F if you are married and previously filed an I-130? Also, if you are married I-129F is the wrong form (it's a petition for alien fiance).

No, it is not. The I-129F can be used for a spouse, once the petitioner has a receipt notice for filing an I-130 for spouse. It is NOT an APPLICATION for anything. It is a petition. In reality, it is a petition that once filed will slow the processing of the I-130, and then get closed once it arrives together with the I-130, at the National Visa Center. The K3 visa is virtually unobtainable at and has been for two years. but the I-129F is definitely a petition designed to be used for both fiance and spouse. It's just that USCIS doesn't issue visas.

To the OP's actual question, USUALLY the second notice of action is an approval notice but they can send as many notices of action as they see fit, including a second notice that is either an RFE, something else, a DENIAL or an approval.

They file the I-129F because they don't know it's useless but there is no fee for filing the I-129F for a spouse after filing the I-130.

One files an I-129F 'in this manner' when persuing a K-3 visa.

But K-3 visas are so 'last decade' - it's a useless goal, to be certain.

Where's the additional 340 come from? I am thinking yer greatly confused for any K-3 process. Yer right, however, about the AOS process.

On the USCIS page says before applying for K3 visa one have to apply for I-129F. And folowing the instructions, the K3 will alow me the wife to be in the State waiting for the i-130 so after filling I-130, we filled the i-129f thinking it will be sooner as we read on the site just to find out they all take the same time now.

You are right, the K-3 was designed to allow the spouse to wait in the US while the I130 was being process. However, that was when the I130 was taking YEARS to process

Since that is not the case now the K-3 is useless and slows down cases more often than helps them

I'm confused: does USCIS assign an alien number while processing the initial petitions? I thought it came later. We didn't have an alien number on our approval notice.
