Hi Folks i am in need of some explanation as not able to find any information on this topic.

My Mom is USC, and she is preparing to file I-130 for her married daughter, who is outside of US. The question we have is,immediate relatives will need to be listed on I-130 (ie; Husband, unmarried child)of beneficiary. Will this cause any issues if unmarried child of beneficiary wants to apply for a student visa while waiting on visa number? since her name is already listed on I-130 as a relative of beneficiary. We wanted to go ahead and file but wanted to be sure that this will not cause any issues for beneficiary's unmarried child.

It shouldn't be a problem at all. Because I-130 is for an immigrant visa-and AOS. And student visa a non-immigrant visa totally separate category. Infact, whilst applying for the student visa, a person should and must indicate that an immigrant petition has been filed for him/her. Hope that helps!

No, in fact, a student visa IS a non-immigrant visa but the F-1 applicant must actually prove that they WILL return to their home country. If an immigrant petition is pending...well, this is sort of moot then.

Trust me, as someone who had a student visa, I'm familiar with the process

Umm...what?

No, in fact, a student visa IS a non-immigrant visa but the F-1 applicant must actually prove that they WILL return to their home country. If an immigrant petition is pending...well, this is sort of moot then.

So does this mean that there is a possibility that it can be a issue if she plans on applying for F1 visa while her mother is waiting on immigrant visa? any suggestion on how to handle this situation? seems you have had some insight on this matter. I was thinking not to include unmarried childs name but then again it asks for all the relatives of beneficiary.

Appreciate your input, kind of makes sense. As far as cost involved that is not a issue here, we just wanted to make sure if we are thinking through this from all angles.
