My husband lost his russian passport and I-94 years ago. We got married in November 2011, and mailed a package with I-130, 485, 131, I-102 last weekend. My husband also started a process on getting a new passport from Russian embassy, which might take up to 6 months. We are hoping to get a replacement I-94 before the interview. Do you think that our package can be rejected due to missing copies of passport and I-94. We included a statement that it was lost and that he is in the process getting a replacement documents. Any sugestions? Thank you

You should of included a copy of the police report with the letter about the lost/stolen passport.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

You should of included a copy of the police report with the letter about the lost/stolen passport.

My husband didn't file a police report. And we are afraid to file it now, because he overstayed his visa.

12/16/2011 - Received emails for I-130, I-485

12/22/2011 - Received NOA in mail for I-130, I-485 dated 12/16/2011

12/23/2011 - Received rejected I-765 due to missing signature

12/24/2011 - Received biometrics appointment on 01/09/2012 dated 12/20/2011

12/27/2011 - Reapplied I-765

12/29/2011 - I-765 has been delivered by USPS confirmation

Yes, you do. But it also says if any documents are not available submit a detailed statement of why they are not available. Form I-102 to replace I-94 was submitted with I-130 and I-485 package as well.

It should be reported. It's a government document. Just stating it's lost may not work. When immigration check your documents your new passport number will not correspond with what's in their system. It can raise flags.
