Divorced or not when filing petition

It is also possibe the person at RAGS does not know what they are talking about, would not be the first time. She can go back and ask for a supervisor.

First call Kiev and ask them. You will not be the first to ask and I simply do not believe that a passport stamp is accepted in lieu of a divorce certificate.

The other story has two holes in the first paragraph.

"She has court records to prove it..." Doesn;t HE have those, HE filed the petition

"She did not have the time and money to get her passport stamped..." For two years? BS.

I will call Kiev. He does have her papers. I agree about the stamp but we don't have a divorce certificate only the court papers with seal on them. They are originals.

Timeline

My Alla was divorced twice and had her, what we would call the decrees from both,a 2 page document stamped by the court, this was all that was used for the petition and the interview and both were accepted. I had them translated for the petition and she took the originals with her to the interview. Our time lines are close and she was never asked about a passport stamp or did she receive one. You can email the Counslar's Section and they are prompt in answering questions. I retained the emails for her interview. If this does not help, let me know :)

Finally someone with positive news that has gone through this. This is exactly what my Alya has. A two page doc original stamped by the court and I used it along with a translated one to file the petition. The papers say judgment on them at the top. Is this what you had? I hope it works out the same for us. I dont know why they would even ask the other girl who had the issue for her ukr passport.

So I guess its not true where they say on the Kiev site that they dont accept court documents to prove divorce. I'm hopeful but still a little worried. It took so long to get to this point and to even think................

I emailed the embassy and im waiting for a reply.

I can't speak for Kiev, but the Moscow USCIS accepted the divorce court ruling in our case, though they did point out that it is in fact NOT the same as a Divorce Agreement. It was funny because the USCIS clerk confided that he knew this because he'd been through it himself! As such, my lawyer is visiting ZAGS tomorrow to pick up the aforementioned Divorce Agreement, just in case the IV Unit officer wants to see it next week during Natasha's interview.

The way it's done here in Russia is that you visit ZAGs with an official copy of court ruling, notarized copy of passport (with translation if foreigner) and fee of 400 rubles. ZAGS will then issue the Divorce Cert within a day. Ukraine must have something similar, even if it's not ZAGS (or RAGS) anymore. Keeping an official record of such event in someone's passport (which can be lost) is simply ludicrous.

I'm with Gary... don't wait. Call the consulate in Kiev ASAP.

01/11/12 - Submitted I-130s to Moscow USCIS in person

01/12/12 - Had interview with Moscow USCIS officer to establish bonafide marriage

01/12/12 - I-130s approved and passed to US Consulate

01/13/12 - IV Unit in Moscow received approved petition

01/23/12 - We received confirmation that I-130s were approved by USCIS

01/24/12 - We received package notification from post office

01/26/12 - Picked up "package" - notifications from IV Unit with case numbers

01/26/12 - Set interview date online

02/01/12 - Passed medical exams

02/02/12 - Received police record

02/09/12 - Interview... APPROVED!

02/13/12 - Visa delivered

02/23/12 - POE Chicago

I can't speak for Kiev, but the Moscow USCIS accepted the divorce court ruling in our case, though they did point out that it is in fact NOT the same as a Divorce Agreement. Did your girl try more than one ZAGS in Kiev? Perhaps the one she visited gave her bogus info. I've seen huge variations in how various government offices in Russia and Ukraine operate, despite being under one administrative body.

Did your girl try more than one ZAGS in Kiev? Perhaps the one she visited gave her bogus info. I've seen huge variations in how various government offices in Russia and Ukraine operate, despite being under one administrative body.

She isnt in Kiev. She is in a smaller town which I think only has one ZAGS office. I already asked her to go back and ask a supervisor or secondly go to Odessa and another office. She will do it if needed.

Who did you call? Wrong number! Sounds like you called the appointment number. Call the consulate visa section.

This is seriously messed up because what you are saying is they require a document that is no longer available but will acceot a document that is not listed. That is, frankly, nuts.

Look, this is getting nuts. You do not pay to call the consulate, you PAY to call the appointment center. That is NOT the consulate, it isn't even in Ukraine.

Call the consulate visa section, their number is on the website but I posted it above. Ask for a supervisor. They open at 8am Kiev time and that is a good time to call.

The clerks at ZAGS make mistakes all the time, Alla had to have her divorce certificate changed twice! They are $200 per month clerks! Slip them a $20 bill and they will do a divorce certificate while you wait in the hallway, they did it for us!

I don't see the number you gave me on the Kiev page here or on the embassy site. unsure.gif BTW I found out they stopped giving the divorce certificate June 2010.

The other girl you refer to, I will bet you $$$ to donuts is a phony, a scammer. Ask that memeber whathe has done since. Scammers will do this, show up at the nterview and purposely not have a correct document or not show up and simply make a story. It has been reported here several times.

Two questions to ask that guy...

1. Is he/was he sending money to her

2. Is their relationahip continuing and do they have a new appointment date.

His review stinks like a whorehouse at low tide. For one thing she would not be denied, she would get a 221g request for more information. I think the guy got scammed, and not that I judge on such things but take a look at their photo.

The info above is great and calling the visa section will settle it once and for all. When you read a review that differs radically from all the other reviews, you need to suspect the validity of it. The guy is not a liar, I am not saying that, I think he got hoodwinked

I guess I am not doubting they stopped issuing them, seems wierd the consulate has not caught up to the news. Can your fiancee get something in writing from them to that effect? At any rate, call the consulate and ask.

I hope the number I gave you is still good, it was not a regularly published number, it was still the correct number as of last year. The site used to list another number for the consulate but it was not the visa section. A friend of mine used to work in the Kiev consulate and is now in Bucharest. He happened to be traveling with me when I met Alla. She didn't like him. :P He transferred to Bucharest shortly thereafter and was not there when Alla interviewed.

Seriously it will be good information for everyone here, that is the idea of this forum, to keep up on regional news and changes.
