Why would you file an expedite when the military spouse is deployed? Maybe I'm not getting it but what I'm trying to ask is why would you speed up the process for the wife to come to the US and the husband is not even in the US? (It's deployed! and probably somewhere else far away in the world). Can someone explain please?

To answer the question about the health insurance coverge overseas. There maybe benefits for coverage overseas, but the member must pay up front to the hospital then submitt the bills to the Health Insurance company to be reimburse. If they have a straight HMo policy, then their benefits would probably be very limited as to what is covered out of network. The only coverage out of network might be medical emergency only. The husband NEEDS to call his health Insurance company to inquire about what benefits the family has.

Just my comment on how Insurance works.

Did you resolve whether you need to file a waiver as well?

The expedite is due to the health of the USC child not the petitioner's deployment/military status.

I think it is more financial, the child can come back anytime.

It could be considered both yes because my husband cannot stop workung to care for her aline. His family is in maine welive in arizona. Daycares do not accept a child with her issue as they would have to be trained to place the tube, workthe pump. Unlessyou aresaying my 6 month old can drive herself to therapy, appountments and feed herself then yes it wouldbe ok for her to cone back with him. Also you are trying tosay that her health issues are not serious and iam not going to accept that. I haveseen expedites for the most stupid reasons and i am going to fight to get my daughter back where she belongs withher mom and dad totake care of her.

I will have him call. But we can foot crazy expensive bills more than we alreadyhave sounless it covers almost all we will keepon the mercy of public health.

Yes most likely i will have to file a waiver. Spoke to a lawyer who said i have a case to win on a expedite waiver also.

Everyone here is sympathetic and trying to help you out...no need to bust on other people's lives/worries as "stupid."

You appreciate it would have to be expedited at every stage and you are talking about reducing the time to months rather than years.

Mr and mrs

Why dont you bash other people that say insensitive things about my situation. I will not let you pick on me so find someone else to pick on and you made your conclussions that i was saying something about that member that is in AP when it wasnt so get your facts straight.

And i will say loud and clear yes that is my only option unless you want to give my husband a slary so he can stay at home and support 3 households, his, his daughter from previious marriage and me.

And unless you have been thru what i have you should not open your mouth to say things you do not know. Yes i should have filed aos but i had a sick child to care for where i as driving to therapy and doctors almost daily. Get my 911 records and see how many times i had to call 911 because she stopped breathing during an episode. Sorry my mother was almost dying and i had to leave. We never imagined this would be so hard and long. Like i said my mistake for listening to a uscis costumer rep.

If you want to pay for our dr bills or for him to care for her exclusively hey you are more than welcome.

USCIS will never fool anyone. I know we all have different situations but its not right to label them that word.

Just follow through and go with the flow and your papers will be approved.

I agree with you but it's kinda hard to not think like that when people have been calling to find out about the I-130 petitions and the only answer they come up with is "We are processing july 16 petitions" or "It should take us more 90 days to process your petition" while in their own website it's clear to everybody that the processing time for I-130 is 5 months, and they have been giving the july 16 answer for 2 or 3 months already...

I am actually going with the flow and being patient to wait, but I would never dare to judge someone with a sick child that needs health assistance in Brazil.
