I'm not.wrong. I know it says a Green Card Holder can stay out Outside of the USA. Expect to have issues at the border pushing to the 365th mark.. Person would have a hard time entering the USA. Same like a visitor is allowed 6 months into the country pushing it into the end of the 6 months would eventually cause issue. It's like dont push the limits given.

Your mom is right. Keep in order to file the form I-485 and Adjust your Status you MUST be in legal status when the priority date becomes current - No Option. This means you should continue to attend school and keep your F-1 status active. I agree that America can be boring sometimes... After all it's a place where we work work work .. go to school.. and have little time to have fun.. away from work. many would say you work to pay your bills.. or you work and dont have the free time to even spend the money.

I know I must remain my F1 status to be legal in the US, but I'm confused about the aged-out problem. I don't know if my brother has applied the I-485 or not because the retrogression last year made everything complicated.

Everyone in my family is aware of aged-out problem but maybe I should confront my brother and ask him directly.

He can stay upto a year but only in some sort of circumstances. Like if he is sick or so. In that case he has to given a written statement to the immigration stating why he had to stay there for that long. If he continue to do that many times then they can terminate his permanent residency. I has happend to me once. My mom stayed in india little over than months. she was given a warning that if she would stay there again for that long then they will terminate her GC. Why taking risk ??

Even if you return to the US within a year, repeated instances can be viewed in a negative light. When I moved to Japan, I went to Guam or my hometown in the USA once a year, just for a few days (so as not to break my Permanent Resident status). On my 5th trip, the immigration officer informed me that if I continued to do so, they would have a judge revoke my Green Card. Unfortunately, my time in Japan also means I'm not eligible for Citizenship until I've been back 30 months in the USA (to complete the Continuous Residency requirement), so my wife and I have been apart for nearly 2 years now. :(

If you must be out of the country for more than 1 year, there is a form you can file which will allow you to remain out for up to 2 years. I can't remember the name of the form, sorry.
