When did ur case gt approval by USCIS, tell me the exact date. You might be saved under the CSPA, and wats ur date of birth. Only then we can help u out to tell u the real picture, wat would happen to u.

To understand the CSPA procedure, PD is not important but the Case Approval Date is very important to know whether an applicant save or not.

Your pd is 3 Sep 2009.

case approved on 17 Aug 2010. (Took 11 months to get approval)

Therefore, you have 11 months rebate in your case.

Right now ur 23 years 3 months older, suppose your case will get current next month. You will be 23 years and 4 months older by then and if they deduct the time took in approval which is 11 months only.

Your age will become 22 years and 4 months after deduction which is 16 months over 21 age which is prescribed by law. Unfortunately, there is no chance to get an interview call for you and hence you wont get a greencard this time.

Now, you have 2 possibilities:

1. If u are a derivative beneficiary, then you have to wait till the fresh petition filed for you in F2b. In that case you will have to wait for 8-9 years after filing it.

2. If you are beneficiary of this petition, then you will retain this priority date and you category will automatically converted into f2b and you have to wait to get ur pd current, again the wait is too long bcoz 2009 pd will take up to 6 years from now.

If 1st condition applies on you then tell ur one of a parent to apply for u asap, dnt lose a single second bcoz picture is clear that you wont get a greencard this time.

Who told you about this "Age Lock" phenomenon?? :huh:

Its a News to me, look i told you on the basis of information given by you. On that basis, hannah believe me accept the truth there is no chance and there is no such thing like Age Lock exist. There hundred thousands applicants out there who got current during booming days of 2010 for a month or two and suddenly this retrogression has changed the whole picture instantly.

If u done with an interview at that time there might be any chance to get through this, but if u didnt done with interview when ur pd was current then there is no hope.

By the way, if you find anything on "Age Lock" rule anywhere on net then do share with us. I am curious to know the logic behind this rule and when did this bill was passed under which section of Immigration Law and what is the name of this Act. (If it is really exist)

To our F2A watch list it is better to track the citizenship dates for F2A Applicants and also ones who jump to F2B coz of Age reaching 21.There should be atleast half or quarter of such cases that will be out of F2A quota.Then by the last quarter the VB will make huge jumps(6+ months jumps) like it did last yr.Also heard that coz of elections lot GCs will be given in this FY.Any news from anyone or immi. Lawyers about this?

Looks like Puru444 is right..You have to be interviewed before you are 21(plus.the CSPA age).Doesn't matter when you were current before.

"Section 3 of CSPA amends section 203(h)(3), INA as follows:

RETENTION OF PRIORITY DATE- If the age of an alien is determined under paragraph (1) to be 21 years of age or older for the purposes of subsections (a)(2)(A)and (d), the alien's petition shall automatically be converted to the appropriate category and the alien shall retain the original priority date issued upon receipt of the original petition. I also read that:

"The clear and unmistakable import of the BIA decision is that where an alien child is a derivative beneficiary under a principal beneficiary of any preference petition, and is determined to be 21 years of age or older and has therefore become ineligible for the benefit of § 203(h)(1), he or she may nonetheless be eligible for retaining the earlier priority date of the original petition that enabled the original principal beneficiary become a lawful permanent resident.

The principal beneficiary may then file a relative petition for the derivative beneficiary who would then fall under the second preference category as an unmarried son or daughter of the principal beneficiary.
