WRONG DATE STAMP IN PASSPORT

Timeline

HI- so we were filling out my husband's AOS paperwork today and found a potentially major problem. the fine folks at JFK stamped his passport and I-94 as February 6, 2006. He actually entered on February 7, 2006!

Of course, his passport was also scanned at JFK into the computer, and we are betting that he wll actually be in the computer system as arriving on Feb. 7.

What should we do? Is there someone at USCIS we can call and ask what to do? We are really worried that the contradiction in dates will slow our AOS process down, if not create serious glitches.

What date should we use on all the forms he has to fill out? The stamp date or the real date??

Suggestions? Has this happened to anyone else, and what did you do?

Again, any phone number to call would be great too.

Oct 04- NSC receives Petition

Oct 7- Check cashed, we're in the system!

Oct 12- NOA1 receivedl

Oct 21- NOA2 RECEIVED! (email)!! yeah baby, yeah!!!!

Oct 25 NSC ships application to NVC...really rolling now...

Nov 4- NVC ships case to Dublin!!

Nov. 24- Packet 3 received

Dec. 8- Packet 3 materials mailed to Embassy

Dec. 13- Medical in Cork

January 27, 2006- The Interview- SUCCESS!

Feb. 7- He arrived in America- welcome home sweetie!!

Feb. 8- legally married at the Indianapolis clerk's office

Feb. 25- Mailed AOS, EAD, and AP to Chicago lockbox (packet weighed 2.6 pounds!), rec'd Feb. 27

Mar. 6- Received NOAs for I485 and I765, rejection for I131 (incorrect payment). I485 has wrong A#.

Mar. 7- Resubmitted I131

Mar. 14- NOA for I131

April 1, 2006- our Wedding with family and friends in Michigan!!

April 14- Biometrics appointment in Indianapolis

April 25- received Advance Parole

June 19- AOS interview, Indianapolis--APPROVED

June 30- GREEN CARD ARRIVES!!!

The same thing happened to my son and I. We entered on May 24, but our visa's were dated May 25. I used the May 25 date on our forms.

10 year GC Approved - APRIL 16th ,2009 - Peggy and Jonathan's......

Still waiting for our cards...Had to file I-90 as they sent them to the wrong address.

March 9th, 2010, Received GC that has been lost in the mail for 10 months. Still waiting for my son's that is lost as well.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.

Same happened to me. I was due to arrive one day but the flight was delayed and it was actually well after midnight when we landed but the POE people never changed their date stamp. I got my greencard without any probs so it probably doesnt matter at all.

Seems to happen a bit if you're on one of the earlier flights in the day. My wife put the actual day of arrival on her form (not the one on the I-94) and we included a note with the application stating that the stamp was wrong and attached a copy of her boarding pass. We didn't have any problem.

If you want to get the I-94 corrected, you can go to any international airport and look for the CBP Deferred Inspections Office. They can correct the I-94 for you.
