Hello fellow Vjer's,

I would like to ask ur opinion. I am getting ready to file my N-400. I am filing my income tax as married but filing separately so my hubby's ex wont get part of our refund. We been filing married joint since we got married in 2007.

My hubby has only worked for a month the whole year of 2010.

My questions:

1.Does he need to file his income tax even if he only made a couple hundred dollars for the year 2010?

2. If I file separately but married would it not cause red flag in my N-400 application?

3. If he won't file since he only worked for a month would it cause red flag on my citizenship application.

4. What is the other way that my husband's ex wife can not get part of our income tax return this year(from the child support that my hubby owed).

5. My hubby is unemployed for almost 3 yrs. now and all the income comin g is from me. I do not want to pay child suport the he owed from his ex.

I would appreciate any help.

File married filing separately AND file the form Injured Spouse. This way his ex cannot get your money. I filed married separately & had no problems filing my N400. It is perfectly legal. Good luck on your citizenship journey.
