Hello! I have 2 questions.

I am with a student visa, I got married in November 2011 and I am starting my I-130 and AOS process.

The G-325A form asks to list the employers for the last five years. I have worked without work authorization with my SSN for the past 6 years and paid taxes. I intend to write the truth. How is this going to affect me?

I-130 form - question 14

"Date authorized stay expired, or will expire, as shown on Form I-94 or I-95" -(My I-94 says Class F1 Until D/S) Should I write the expiration date from my visa or the expiration date from my I-20?

Thank you!!

Moving to AOS from tourist, student, work visa as OP is not doing CR-1.

OP - be honest about your work. Others have been in your situation - look around the AOS forum.

This is grossly incorrect.

Anyway, OP, most illegal work is irrelevant/forgiven for spouses of USCs who adjust in-country. The exception is if you stole a SSN or if you claimed to be a US Citizen on your employment forms, that is not forgiven. You should be honest, and you should have proof of taxes paid. Good luck.

Oh, write D/S.

the kiss of death... I could not really understand that! I am really stressed out with all these and this did not help!

Anyway, I came to the US 8 years ago with a J1 visa. I got my SSN the first month in US. I worked with my SSN and paid taxes, although I fave been with an F1 visa and I am not supposed to work. I did not steal anybody's SSN.

I will write down my employer's infomation. Should I send them copies of my taxes also, or should I have with me for the interview only?

Thank you Harpa Timsah for your help so far!

First question: Did your J-1 have a 2-year Home Residency Requirement? Second: Did you ever claim to be a USC to get your job?

Have your taxes ready for the interview.

No, my J1 Visa did not have a 2-year Home Residency Requirement.

After 2 years with J1, I changed it with M-1 for almost 3 years.

For the last 2 years or so I have been in US with F-1 which is about to expire.

Is it important to send my I-130 and I-485 before my F-1 expires?

-and no, I did not claim to be an US citizen. It is a small shop that needed help, they liked me, hired me without many question and only asked me to tell them my SSN. I have been working with them for 6 years now.

Working is not a kiss of death, or any other such dramatics, good grief, unless your work was as a prostitute or drug dealer and you admit it. I doubt that.

I sincerely doubt they will even pay attention to it, if they do just answer honestly.

DO NOT LIE on the G-325a

As long as you worked with your own name & paid taxes,it should not be a problem at the AOS stage or after.Working without authorization is overlooked for USC spouses.Goodluck.

I have worked without authorization for a long time and yes, I was also very worried about disclosing that information on the form G-325A. However, I did it, I listed ALL my employees and I do not regret it. AOS was approved with no problems at all.
