Question:

Our case closed at the NVC Jan. 20 so we are waiting for an interview date which can take anywhere from 2 to 3 months, (I guess)...

Question is: Can we request from the USCIS for an FOIA?

We just don't know if this will jeopardize our interview process, if it does than we will wait...

Not sure as to the purpose of the FOIA request? It may result in delays of your petition, and there are fees associated with the FOIA request, refer to the State Dept. Information Guide for more details. Consider reporting back your experience to the forum.

What set my question off was that we got one of his police records from back in 1992 it had on there possession of 2.8 grams of marijuana, which he was buying for his supposed buddy and it was an undercover cop but he was the one caught so he was the one that got voluntarily deported and a 10 yr ban, which he more than served, but we now have this hanging over us which could set off for a waiver... so just somewhat getting ready for that.

IMO, since the immigration casefile is not at USCIS anymore,

a FOIA inquiry into USCIS will NOT slow down the current casefile processing.

It's two seperate cases, aye? there's NOW, and then there's the thing from ages past (which is what you want info on)

I'm sorry this is getting sticky for you...

If I were in your shoes I would want as much info as possible before the interview. The NVC will be scheduling the interview based on the availability calendar that the US embassy in Tegus provides to them. (btw if you're not calling the NVC on a regular basis, I highly recommend it, most of the folks I spoke to were friendly and I got the interview date by email a few hours after a phone call) Best times are early in the morning and evening.

Thank you Amy, I heard that it is taking almost a year for a person to get the FOIA records, so that is out of the question, lol... so I guess what ever happens happens and we will just confront them as they come...God is with us and I have big faith that all will be just fine.
