"Thank you so much! I will have to ask my hubby to let their congressman involved with our application and probably his medical reports too.. cuz he is undergoing into PTSD counseling.

As per this below: this is what my hubby filed for me.. and it stated 5 months.. hows that? =(

I-129F Petition for Alien Fiance(e) K-3/K-4 - Already married - spouse and/or dependent child 5 Month"

So exactly which petition did your husband/fiance file? It is nor very based on the information you provided.

You can forget anything to do with a K-3, that will be administratively closed at USCIS.

Are you currently the wife and your husband filed a I-130?

I see that you are the wife...sorry I was in the mist of posting when you posted

you are the wife.

In that case can we assume your husband submitted a I-130 on your behalf?

If he submitted an I-130, you might need to have just a bit more patience/

No, not a good idea to reveal your case number here, this is a public site.

If you are the wife OP, then your husband only needed to file an I-130 petition

I think what you mean is your husband submitted an I-130 and a I-129,

is that correct?

Ok, since you are already married, then you are not eligible for a fiancee visa.

The fiance (e) visa is those that are not currently married.

but how long it usually takes... my hubby used to work as a military.. will that help to speed up the application?

He only can file for one visa petition. I-129F if you are not married and intent to marry here in USA or I-130 if you are already married and intent to bring you here to the USA.

Ok, I think what your husband did was to submit both an I-130 and a I-129 petition, he

did not file for 2 separate visas at once...that is not possible.

I have to assume he was told to file both petitions (at the same time) for the purpose of a K-3 visa.

What will happen is the I-129 will be administratively closed at USCIS and the I-130 will be processed

and you will immigrate on a CR1 visa.

Average wait time is 5 - 6 months until NOA2. Being that he is no longer active duty he can not expedite his petition. In order to expedite, he needs to be active duty and in process of being deployed in order to expedite.

No, the fact that he is a veteran alone will not speed up your petition.

but he was allowed to file 2 visas??? is the fiancee visa be forfeited?

Go back and read my earlier reply with regards to this. The I-129 will be

administratively closed and the I-130 will be processed.
