I am petitioning my mother to come to the U.S. My husband and I are both self-employed, so with all of our tax deductions, we won't be able to meet the 125% guideline. We can, however, include our assets, which must be at least 5 times the difference of the our income and the 125% poverty guideline. If we add up all our assets, we have more than 5 times of what is asked to qualify basing on assets. While I was filling out the I-864 and after my husband filled out the I-864A, I realized that we both have disclosed our JOINT bank accounts. It will ask for me to ADD both of our assets, and that means, the amounts in our joint bank accounts will end up doubling. I tried to call the USCIS on this, but they don't know the specific answer to it. Should I keep the amounts as is? or should I divided the assets in two so they'll add up exactly what's in our bank accounts?

I'll advise only one of you declares the balances in your joint accounts. If you have several accounts, I'll say you can split who declares what. At the end of the day, the total amounts should add up. You do not want a situation where you both enter the same balances, and the person reviewing it assumes you are trying to game them.

If they are joint assets, each of you declares half.
