I am about to file Form I-130 to petition my mother to come to the U.S. I am currently filling out the I-864 Affidavit of Support and my husband is filling out the I-864A since we're combining both of our incomes and assets. Everything is clear except when I started to fill out the part where I have to disclose our savings and checking accounts. My husband and I have a joint account and in both I-864 and I-864A, we need to fill out the total amounts of our bank accounts. However, in the I-864 item# 29, I have to add the total assets both from the I-864 and I-864A. That will end up doubling the amount of our bank accounts. I tried to call the USCIS to ask about this and they said they do not know the answer and that it is not in the instruction about a joint account from both the petitioner and the petitioner's spouse.

Does anyone have any idea about what to do in this case?

Since your mother is not in the USA the AOS isnt required.

you can't file the i864 yet, that's at the NVC stage. for now it's only the i130. since the i130 can take from 5 to 7 months to be approved, it will be approved after April 17th, so the latest tax return will be 2011.

the assets are optional and only needed if the sum of both incomes isn't enough.

Thank you very much for your quick response. I called the USCIS and they did say that it's okay to send the I-864 with the Form I-130 if it is already available. When my fiance filed the K-1 visa for me before, he filed the Form I-864 with it and it was faster because they forwarded all the paperwork all at once after the petition was approved. He filed it sometime January and it was approved within one month. I did my interview in the Philippines in March, did my medical exam by April, and by May 15, I was already here.

Anyway, we have to include our assets because we're a family of four and we're both self-employed. With all of our deductions, we won't be able to meet the 125% poverty guideline. The main concern I have is the joint bank account we have and what I should do with the total amount for both the checking and savings. Should I divide the amounts by two so when I add both of the amounts from form I-864 and I-864A (my husband's), they'll add up exactly what's in our bank account? If we include our assets (bank accounts, stocks, bonds, mutual funds, etc...), we will be able to meet the financial requirement, which is 5x the difference of the income and the 125% income guideline.
