OP you'll be fine. You're not the first and you won't be the last. File for divorce, file ROC with the divorce waiver and wait.

You said you had it all ready to go so I assume that means you have all your evidence. You just need to redo the I-751 to be with a divorce waiver.

I'm sorry you're going through this but you know, she didn't actually wait till the last minute. There have been people who've filed joint and then the USC has refused to go to the interview. There is still hope for people even like that. One gentleman had to file 3 months late because of the drama going on with his ex-wife and he was approved. It happens. It will be okay.

Good point, I hadn't thought about that one! Doesn't sound like it will work for the OP, though, but hopefully they live in a state where divorce doesn't take too long.

Yeah, I don't think this will be an issue at all. Even if the divorce does take a while he won't be deported. If he doesn't reply to the RFE in time he'll be denied for the lack of divorce decree BUT he will then go before an immigration judge who will extend the waiting time until the divorce has been approved and it will be fine. Happens often.

I have used this site a lot for help, throughout the entire process - you guys are amazing. I appreciate you all taking time out of your busy lives to help people such as myself. I have until March 10th (when my green card expires) so hopefully I can look into divorce proceedings, see what all that entails. Sadly, I'm not knowledgable on any of this. We currently reside in Florida, do not share any debt and have no children. So far as I can tell, this is all going to work in my favour. It's not the resolution I want, but my wife doesn't seem interested in resolution.

If you are in Florida, then you are in luck. There is no waiting requirement in Florida. With no joint assets and no kids, it can be done very quickly. Sorry you have to go through it though. Best wishes.

I have done a bit of research into it, it doesn't appear to be horrendously expensive - thankfully we never bought a house or had any children yet. I'm not sure what the next step to take is, fortunately I have about 5 weeks to figure something out. Obviously the sooner, the better.
