Timeline

I married my K-1 when her daughter was 20 years old. The daughter will file her AOS three months before she is 21 years old. Am I correct in believing that she will "age out" if USCIS does not approve her AOS prior to the date she turns 21?

If she "ages out" does she have to return to the Philippines right away?

As long as her daughter entered the US before 21, she will be ok. That is the key point. She can apply for her AOS. She will no longer "age out". That issue was put to bed last year with a ruling from the immigration board. I am assuming she entered as a K2 ?

Yes, she came in as a K-2.
