I contacted the congressman's office again yesterday and they phoned Vermont. Here is the response I received:

I did talk today to our Congressional Liaison in Vermont and she promised to shoot the officer, handling your application, an email to find out about the status of it.

I reads so funny.... I thought at first... "shoot the officer"? Okay... as long as you hand our file to someone else first.. :rofl:

Do they have final decree certified by court clerk (after signed by Judge AND after required 30 day waiting period)? Or signed final decree by Judge prior to waiting period (ie, copies made prior to filing final decree with clerk)? I had to go back to court 90 days after the Judge signed my document to get truly final document, certified copy from clerk of final decree.

When he went to the county clerk's office and asked for that they gave him the nisi... and we thought that was his final decree. The paperwork he sent has a final divorce date signed by the judge and the court clerk (I believe) and it says: "Final Divorce Decree".

I know that the final decree was filed with the court because his ex-wife was re-married I'm thinking about 3 years ago or so... so the divorce has to be finalized by the courts or she wouldn't have gotten a marriage certificate?

So I guess I'm really not sure if it is the decree before or after the waiting period... I haven't seen what he sent them for our RFE... I hope it is fine though... fingers crossed.

Hope so, just can't imagine what take so long to finish 1 paper. Only that the clerk would have to sign or stamp it at least 1 month after the judge, showing a file date of at least 30 days prior. I had my long form in hand, signed Oct 1, but had to return after Dec 31 to get official decree from clerk, which proved when it was filed and that the waiting period had passed. I'm sure it is final, but also maybe the ex went back after waiting period for proof... or even stranger for me was when we file for marriage in massachusetts, they didn't ask for any ID or documents... they just took what we put down and granted license ready to be signed by justice of peace (after 3 day wait). The JOP asked for her ID (passport), but not mine??? I guess the city clerk trusted our word, as we had documents ready to show, but they never asked.

My internet was out yet againnnnnnnn ahhh! But we are also counting down the days!!! Less than a month now...wow!!! :o I better get to work selling the last of my furniture since I can't ship it to the States.....!

Hey again Texas, read about too many denials here and people have to start over. Don't want to beat a dead horse here, but If the uscis does not already have copy of certified copy of divorce decree (post filing with clerk), not just copy of final decree before filing!!!, i'de route one through your channels asap. i'm sure the divorce is final, and though the decree is public record i doubt uscis is going to do the leg work for you. Wishing you speedy approval!!!

Clerk's Certificate of Fact:

I further certify that as of this date the following facts exist: D & R's divorce was final on the 16th day of January 2007 and thirty days have lapsed since this divorce was final and no appeals or further orders concerning the final decree has been filed other than child support orders.

Given under hand and seal signed by the district clerk... along with final divorce decree... all of this is in the hand of Vermont....should be enough, I hope. :bonk:

There is nothing more that the county can give him, he has asked. What further legwork could there be? :blink:

Congrats to you and still can't believe that Kim is waiting for the NOA2... it sucks big time, wish I could do anything to help...

I agree!!! I am so freaked out about how they get to decide basically everything......

And yes, it feels like Friday to me, too...I thought yesterday was Thursday.....who added an extra day to the week?! But yes, Totally Texas Thursday is on!!!!!!!!
