So i was just talking to a friend here in Honduras...a former coworker...and he was telling me about how his neighbor just got denied for the K1 visa! The girl is from here and the guy from the US...they've been living together and she is pregnant and so they thought they "had it in the bag" and went for the interview like 2 weeks ago and were denied with no explanation whatsoever as to why! Anybody have any ideas of why they would not be able to get an answer about the denial??! They went to the consulate office here in the northern region today and the people there treated the guy terribly. I haven't talked to the couple since I don't know them but it sounds scary and sad after going through all of this....ugh. Freaked me out a bit. But then again, they are not here on VJ, so they probably didn't have all of the "right answers" like all of us do, right?! ;)

You said that he was living with her? Were they living in Honduras? The USC will have to prove domicile in the USA. I saw that one on a Canada forum got denied a spousal visa for same reason. She was USC but had been living in Canada for a few years. They got denied at embassy interview.

If you are living together in foreign country, The best thing is to get married and live as husband and wife for 6 months. Then you file cr1 through DCF (direct consular filing)... this is approved in 1-2 weeks and you go in for visa. But yes, you would still have to supply the 864 to show support and how you will live in the usa, just as you do the 134 for fiancee.

Just heard back from Sen. Merkley's immigration staffer. (I contacted the staffer around 1:30 PM yesterday, sent in the inquiry and got a response just 10 minutes ago...efficient!!)

Our petition had been sitting in the CSC mailroom since it was approved and was mailed out to the NVC yesterday. It should be there sometime next week. Of course, it will take the NVC time to get it into their system, but here's hoping that doesn't take a month as well.

For my fellow UK petitioners and beneficiaries, she noted that, "Due to the presence of the Olympics, visa operations at the U.S. Embassy in London will not be at full capacity during July and August. Unfortunately, since visa officers will be diverted to other duties during the Olympics you might experience a delay in the scheduling of your fiancé's K-1 visa interview."

We had already figured his interview wouldn't happen until September, so I'm hoping this keeps moving forward.

Yes. This process is torment..looks like another disappointing start to the weekend...I'm just so tired of it all.

Yea, living here but I don't know the whole situation...I don't know how long he has been here. Frankly, I didn't want to hear anymore! Haha. Got freaked out and stopped asking questions but then had more later that I wished I had asked. I have read that domicile is your permanant home and residence is just where you have been living lately. So since I have bank accounts, insurance, property (car), etc. in the US, I should be able to say that is my domicile..

Yes, that would be great except that spousal visas are super hard to get here...the US doesn't like to recognize Honduran weddings....I had a friend who tried and ended up having to get a work visa and then adjust status later. So I don't know what this other couple did, but we have my mom as co-sponsor for the financial stuff as it is right now in addition to my online job that I will continue when we get to the US.

I think I am going to contact the lawyer I talked to last year before starting all of this and see if I need to go back before the interview now...ahhh. I am scared. I was totally fine and ready until I started reading all of this stuff again!

We should be okay with some evidence according to this:Adjudicator's Field Manual - Redacted Public Version \ Chapter 20 Immigrants in General \ Enforceable Affidavits of Support.[Revised as of 06/27/2006].

If the sponsor is not domiciled in the United States, the sponsor can still sign and submit a Form I-864 so long as the sponsor satisfies the Department of State officer, immigration officer, or immigration judge, by a preponderance of the evidence, that the sponsor will establish a domicile in the United States on or before the date of the principal intending immigrant’s admission or adjustment of status. The intending immigrant will be inadmissible under section 212(a)(4) of the Act, and the intending immigrant’s application for admission or adjustment of status must be denied, if the sponsor has not, in fact, established a domicile in the United States on or before the date of the decision on the principal application for admission at a U.S. port of entry on an immigrant visa or adjustment of status.

In the case of a sponsor who comes to the United States intending to establish his or her principal residence in the United States at the same time as the principal intending immigrant’s arrival and application for admission at a port-of-entry, the sponsor shall be deemed to have established a domicile in the United States for purposes of this paragraph." That is in a thread here about proving domicile...gonna look into this a lot more tonight to be sure of what I can add to our packet. I could move before the date of the interview but wanted to avoid paying for 2 plane tickets and the time apart!!!

DR was great man. Definitely a vacation to remember. Perfect weather and applied plenty of sunscreen. ha. She was not ready to go home haha. And neither was I (unless we could go together). Hopefully, some good news this week, so we can get things moving.

Btw, tomorrow is the 15th??? How the heck are they updating the system tomorrow if no one is in the office?!?! Unless it's an automated scheduled type thing?

7/12/12: Received text notification at 3:45pm central time stating our case had been updated *APPROVED!*

7/15/12?: Received NOA2 in US mail (not sure of this date)

7/20/12: NVC forwarded case to London Embassy

7/27/12: Fiance received letter from London Embassy stating they'd received our case and instructions for obtaining interview

7/30/12: Fiance mailed DS 156, DS 156K, DS 230, DS 157, DS 2001 to London Embassy

8/20/12: Medical

8/31/12: Called DOS and was told interview date: 10/3/12

9/3/12: Sent email to London Embassy requesting interview date be changed

All I know to tell you guys is to keep pushing with your congress people and to keep calling and ask for tier 2 every time. If they won't transfer you, tell them you were being transferred and your phone died while it was ringing ;) I did that and they transferred me on through no questions asked.

If they try to give you some ####### about the computer won't let them do a service request and you're past 6 months, ask them if they can call the service center directly or if they can refer you to someone else who can help

Yes. I think this week is a big week for getting my Congressman involved since we'll hit 6 months. I'm hoping VSC can just take care of us early in the week and that would be a nice surprise. It's just so perplexing to look at Igor's list and see the literal black hole for 1/20 NOA1s. It's a void in approvals, and I don't understand it. But maybe they'll close this last gap early in the week (hopefully by Wednesday and this will finally be over).

Hey, another week is here in couple of hours.

It has to come sooner than later. We will all be approved.. We hit the 6 months mark and that means we are at the end of the wait.

I know it sounds terrible that we have been waiting for such a long time but on the other side that wait is coming to the end. VERY VERY SOON! :dance:

I'm positive too! Terry promised me that if we don't hear anything by the end of next week, he is coming to see me on September 1st so at least now I have sth to count down too! Either way I will be happy! I won't let USCIS to run me down and destroy our engagement time which should be one of the happiest moments in our life...

Are 1/17 are all in the same box ? Because they are not a lot of them being approved either ! 1 once in awhile wich never happen to be mine...Maybe they put us in the 1/20 box...

Yes. My received date on the website is 1/18 but looks like we might be with these misplaced files. This is the kind of stuff that should not be happening. If you say that you process in the order received...well then process in the order received for God's sake. Or at least have some level of consistency. Can't believe this week will be 6 months...Been anxiously waiting for this NOA2 since the middle of May now...Please let it end this week...
