Hello fellow VJs.i just need to know if an over-stayer in the UK is eligible to apply for a fiancee visa to the US.A legal advice is needed.As at when my petition was approved i was on status but when my case number came out my status was over.

i believe that when a USC filed the I-129F for the OP, the OP was in the UK legally... but because it has taken longer than they hoped then they are now out of status in the UK.

If I understand correctly ... your status in the UK doesn't matter in the USA

I'm an over stayer in the UK as well whilst waiting for my husband to get a visa

If I understand correctly ... your status in the UK doesn't matter in the USA

I'm an over stayer in the UK as well whilst waiting for my husband to get a visa

the problem is that the OP needs legal status in the UK to interview here

just like the last time you asked... you need legal status here in the UK to interview at the US embassy

interview for beneficiary will always be done at your legal place of resident...from your questions, it doesn't seem to be U.K.. so you might have to prepare for your main country.. but then not sure how you can re-enter UK if out of status

you are correct mate.Our calculation was longer than we hoped for.So will it be alright to appear at the embassy in London as an overstayer?

I posted this in your other tread but you obviously didnt read it. I suggest you calm down and also stick to one tread. I am posting it here again;If you were to be in one of the west Africa Countries perhaps it wont be a problem but in an Advanced country like UK I am pretty sure it is a No no...Unless you are heavenly favored however, there is nothing impossible with God but I wont gamble with it. I suggest you write NVC immediately to have the case transfered to Lagos consulate. The development will only set you back by 2months cos from all indications, UK Consulate is not backlogged, I once switched embassys as well.I think it is worth it than to have your visa denied. Penguin is right, Your visa needs to be current at the time of your interview...It is just good to cover any loopholes ahead of the embassy journey because the whole visa journey could be very frustrating but sweet ending. Best of Luck!
