Hi,

My husband and I are starting to get to work on the paperwork to adjust his status (he entered the US on a K-1 visa in december) and I had a few questions about the I-864. I am filing an I-864, but my father will also be filing one since he will be a joint sponsor.

Does my father need to file a I-864 or I-864A?

What do I put on Part 3 question 8? It says "I am sponsoring the Principal immigrant named in Part 2" and then I can check "Yes" or "No (applicable only in cases with two joint sponsors)"

Would I check No, since my father is a joint sponsor?

Also, Since my parents file taxes together, does my mother need to fill out the I-864A? Even if all of the household income comes from my father?

Ahh... The other forms have been so easy compared to this one...Any help you can give me will be much appreciated!

In the same boat myself... hoping someone answers you. However my brother had to send a I864 to Norway so I could get my 'now hubby' here. I am using a up to date copy when sending in the I485. Just not sure how to classify in as joint or cosponsors part.

On a different subject I tried 2 times to get a social security card with my husband with no luck so now filing a W7 with my Income taxes so he has a ITN.

If you share a residence with your father, then he could fill out the I-864A and combine his income with yours on your I-864 to meet the 125%. If you do not live with your father, then he fills out his own I-864. Your mother would not need to fill out the I-864A since she has no income and won't be combining her income with his. So, if you do not live together, you fill out your I-864 and your father fills out his own I-864.

On Part 3 you would check Yes, since you are indeed sponsoring the immigrant named in part 2, your husband. Your father would check d in part 1, and also check Yes in part 3 since he will be sponsoring the immigrant in part 2, which is his son-in-law.

You mean what to check off in part 1? You fill out your own I-864 as the petitioner and your brother fills out his own I-864 and checks box d in part 1.

As for the SSN, he should have been able to get one after arriving. I am not sure why he is having a hard time. Did you follow the SSN guide here and print out the paper that shows he is eligible as a K-1? http://www.visajourney.com/content/ssn

Some people have had luck with emailing the SSA through their main site and explaining their situation and why the local office is telling them they cannot get an SSN. The SSA has replied and helped them get the SSN they are eligible to receive.
