Timeline

I'm trying to fill out the Affidavit of Support for my spouse's I-130. I found two very similar forms on USCIS's website. One is called I-864, Affidavit of Support Under Section 213A of the Act, which expires on 09/30/06; the other is called Affidavit of Support Under Section 213A of the Act, which doesn't have any expiration date.

These two forms ask for very simliar inofmration, except for the layout is a bit differnt and also the prior one asks for only the most recent tax return copy, and the later one asks for 3 most recent years'.

So, Can anyone please tell me which one I should fill out? Also, how many years of tax return copy shoud I send in? Thank you.

If this has to do with Adjustment of status you will use the I-864 or I-864EZ. I-864 has lines for assets where the I-864EZ is structured to account for Income only and as its name suggests is easier to fill out. If your income is 125% or more than the poverty line counting dependents, then the I-864EZ may be the way to go.

If you are referring to I-134 that form is used for support of a visitor, and tends to be used at the consulate at K1 or K3 visa interview.

Also I would not worry too much about the 9/30 expiration date since there is not a newer form available.

With regard to tax returns I ordered tax transcripts from the IRS, for the past 3 years, they are free and can be used for this purpose. http://www.irs.gov/faqs/faq1-6.html

On USCIS's website, there is a link where you can download I-485 package http://www.uscis.gov/graphics/formsfee/for...es/i-485pk1.pdf and another link where you can download separately for each forms http://www.uscis.gov/graphics/formsfee/forms/files/I-864.pdf.

The Affidavit of Support in the package of I-485 is just "a bit" different from the form I-864. Which one should I use?

Also, I have all the copies of my previous tax return. But there are many pages. Should I just include the 2 pages of 1040 or should I include all the supplmentary pages as well? Thank you.

I would use the newest one either the I-864 or I-864EZ, if you are using your income only and not using assets use the I-864EZ

Also note the forms in that packet are not fill and print like the ones that you can download seperatly. It is recommended to use the newest forms available.
