Removal of Conditions Question

Hi VJers,

My stepson arrived after my wife on a K-2. He received his Green card this past summer, but is continuing his university education in St. Petersburg, Russia and so spending most of his time out of the country. What are the criteria for a K-2 to follow as far as having conditions removed? Is it automatic if his K-1 mom has already had her conditions removed before we file for his removal of conditions? He will be with us, in the U.S., on his semester break and during his summer vacation. Is the amount of time he spends in the U.S. each year relevant to removal of conditions?

Thanks for any help,

Tom
