Hello guys, I need your advice. My old company filed a case against me way back in 2008 for some missing money in the office but due to lack of evidence it was dismissed. Now my question is will it have affect on my petition? I'm not sure but a little nervous if my NBI clearance will show the said case filed against me. In case it will does that mean I have no chance to go to US?

Did you able to get a new NBI this time? if you did you are good to go..happened to me past 10 years ago.. but I did get a new NBI with no record on file.. goodluck

I will get one soon I'm just waiting for the advise if I can start gathering all my requirements. But in case I have a record even if its not criminal will it affect my petition or not?

... if your NBI clearance would state :

NO PENDING CASE, or NO CRIMINAL RECORD, or NO RECORDS ON FILE, make sure to get an explanation from them about this.....

on the other hand, if it says " NO DEROGATORY RECORD ", this means NBI clearance would stand alone and is so very fine, would not be needing further explanation

... my personal advise is - stop worrying, get the clearance first, and just make the necessary steps once you have the result of the NBI thing.... as they say, live one day at a time...

good luck ...

Wrong information!!!!

An official letter of explanation from the NBI is required for any notation of “No criminal record”, "No pending criminal case” or “With derogatory record.”

You also said:

NO PENDING CASE, or NO CRIMINAL RECORD, or NO RECORDS ON FILE, make sure to get an explanation from them about this.

That is wrong.
