Hello everyone,

I'm dealing with a weird situation and I feel very helpless, let me explain:

USCIS sent my green card august 2011 (my wife and I have been married since March, 8 2011), I never received it. After some email exchange with USCIS, they concluded that the green card was lost in the mail and that I will probably never receive it...

So they told me to fill an i90, check the "never received" box and pay no fee, what I did right away (October 3rd 2011)

We are now mid January 2012, and I just received the response from USCIS about my I90, and it's been declined. The letter says that my Green card as been delivered as promised, they give me an USPS tracking #, and indeed the tracking says delivered August 23rd. But I never got it, and whatever it was, mailman error, mail thief, neighboor that took my mail by mistake, I dont feel like I should be the one paying 450$ I90 fee for that :(

I also called USPS many time about it, and their answer was pretty much "there is nothing we can do, it says delivered so you should got it..."

My I551 stamp on my passport is expiring soon and I dont know what to do. In the letter they said that appeals are not possible.

I can send another I90, but I feel like it will be useless...

Thank you very much for any suggestion, I'm lost here (and poor lol)

You could call USCIS to find out what address they have on file for you. Then once you've determined that contact USPS head office to talk about where the package was delivered and who signed for it (if possible).. which is unlikely.

You could try appealing the I-90 denial with a copy of the email exchange with USCIS in Oct where they tell you to file the I-90 with the fee waived. Had it actually been delivered back in Aug, the emails in Oct would have resulted in them telling you the tracking showed it as delivered, so there's obviously a screw up. I would include a letter explaining it all as well. They can't just "suddenly" find the tracking details months later.

You could also contact your senator/congressman, showing them the email exchange where USCIS admitted it was never delivered and to file the I-90 with the fee waived. Then their denial of the I-90 claiming it was delivered. Ask for their assistance in having USCIS see sense.

If that fails you will need to suck it up and re-file the I-90. You need a copy of the card to file for ROC.

I just had an issue with USPS not delivering something from USCIS, and I when I got the post office on the phone, they told me the name of the person who signed for it (returned to sender). I wonder if you bug them a bit more they can help you find out what happened and if someone did sign for it! I know this must be so frustrating. Try calling post office again to find out what happened to it maybe. Perhaps if you bug them a bit more it will help your case with USCIS. I'm so sorry you have to deal with that! what a pain!! good luck! :)
