OK SO I (THE PETIONER) WAS THE ONLY ONE WHO HAS EVER WORKED, MY HUSBAND(18) NEVER WORKED HE WENT TO SCHOOL WE JUST GOT MARRIED IN SEPTEMBER WHEN I WENT IN TO H & R BLOCK THEY TOLD ME TO FILE SINGLE AND WHEN MY HUSBAND GETS BACK WE WILL REFILE TOGETHER AS MARRIED..AND THEY WOULLD WRITE A LETTER STATING THAT IS WHAT I WOULD DO. IS THIS RIGHT ? WOULD I RUN INTO ANY PROBLEMS WITH IMMIGRATION

Interesting... When Did H & R Block get into Immigration Issues. Never seen them write letters before. I think once you File, you Filed. Whats there to File? He don't work. Just courious myself.

WELL I THOUGHT I HAD TO FILE BEING MARRIED..BUT I CANT HAVE HIM SIGN WITH HIM NOT BEING HERE...BUT YES YOU CAN REFILE CAUSE I WILL FILE AS MARRIED ONCE HE GETS BACK AND RECIEVES A SOCIAL..I ALSO HEARD OF PEOPLE GETTING AN ITIN NUMBER AND IM NOT SURE IF THEY GET INTO IMMIGRATION STUFF I JUST EXPLAINED MY SITUATION AN THEY SAID THEY WRITE A LETTER STATING WHAT I WAS DOING AND WHY I DIDNT FILE AS MARRIED !!

I am however in the U.S. and have been for sometime and do have an ITIN (Individual Taxpayer Identification Number) that i used.

12/17/2011 - Day 12 - Received NOA for biometics

12/21/2011 - Day 16 - Online Update: USCIS mailed RFE for I-485

Timeline

You can be married yes. But, if not even in the Country and together is not a reason to file jointly. You need to be together and have paperwork such as a SSN# and residense. You maybe Married but in the eyes of the IRS and Immigration is a different story. I would go back and talk to H & R Block and ask for a Letter on Company Letterhead signed and dated. They will deny that request no matter what your told.

Married filing Separately. They are a young couple and I see no way of any qualifying dependant. (Re: Head of Household) A Beneficiaries Tax returns are irrelevant in any case.

if your married then you file as married.she does not have to work, she does not have to be in the u.s you need to file a w-7 form gives you a itin number to put on your income tax forms.www.irs.gov down load forms w-7 send it to your wife to fill it sign her name send it back to you you file your taxes along with the w-7 copy of your us passport page, copy of your marriage certifiate, get it nortized, mail per instructions on the w-7 send it all to austin tx.if you wish to call there 1-800-908-9982 get more information.

Married filing jointly would give them the biggest tax break. See the link.

H and R employees are not immigration officers and I am not sure that H&R would write you a letter of any kind. Good luck.
