Please Help! RFE at Interview

Ok so at our AOS interview we had this horrible woman. She said that I couldnt prove that my husband lived at my address because I didnt bring in any utility bills with his name on it. She told me "How do I know u live at (my address) and he doesnt live on the street corner!" Really woman! We are having a baby together! I was so annoyed! Anyways, she gave us an RFE and it says that I must mail her proof that we live together. Ill quote the the letter, "Please provide bills, correspondence, ect. showing that petitioner and beneficiary both use a common address.

Heres where we have an issue. All utility bills are in my name because I moved into the apartment before he did, and since he just got his work permit I was paying for everything so all utility bills were in my name. The only mail that arrives to our home with his name on it is his Wells Fargo bank statements, and a few small things. Would a letter from H&R block (addressed to both of us) asking us to redo our taxes with them work? This might sound silly but how about letters mailed to us from friends and family inviting us to baby showers, sending us xmas cards ect?

Any help would be appreciated!!!! Thanks so much

Bank statement is perfect. You should have taken that to the interview. Send a copy of all you stated that is addressed to him at the residence.

I did take in our joint checking statement but I took in the printout version from online, not the one mailed to me. Im definitely am sending her the one that gets mailed to us.

We included in our AOS package we mailed, cards with envelope showing same address both our names on it. As well as bills ( i was not working but only needed an SSN to put my name on the bills no need to work ) bank statements showing same address with both our names on it. copys of our drivers licenses showing same address. cellphone bill showing both names on a family plan and our address, vonage bill print-outs showing both names on our address. Lots of things you can use!

Card envelopes addressed to both of you are fantastic to bring. We brought a bunch of wedding/christmas cards + their envelopes and the lady interviewing us said they are an excellent thing to bring. Also bank statements/letter from your bank are easy to get.

Unfortunately you're on dangerous ground. Failure to reply to this RFE successfully will result in a denial.

I'm sorry but you being pregnant doesn't prove it's his child. I'm not being mean, that's just the truth. I understand how indignant you must feel being a legit couple and having to prove it when you think it's so obvious but that's the joy of immigrating. The IO obviously found a red-flag in your file so it's time to think outside the box.

So you need as much evidence of living together as you can. Affidavit from the apartment manager stating he knows you live together. The cards, letter, bank statements (a few to prove it hasn't changed). Does he have a drivers licence or state ID? If so his address should be on his card. Does he work? If so he should have his address on his HR file. You said the H&R block letter said to "redo your taxes" so does that mean you filed your taxes jointly last year, if so that's good proof too, your taxes through them should have the same address. What about health insurance? Has he been to the dentist or doctor or anything and if so those should have dates on them.

I sent copies of my ID card and mail he has gotten with the same address and congratulation cards from friends addressed to both of us.

Do you have the envelope where they mailed his EAD to your address ?? Give them some of their own as proof.

Yes, I have all of those things and most of them she already saw. I am sending out everything else today. I didnt think it was going to be this difficult to prove that we are a real couple!!!

Also, is it possible to request a new IO? The woman was attempting to belittle my husband and was treating me as a if I were a criminal, at one point she yelled at me. He may not be a citizen of this country but I sure as hell am.

Did they tell you you'd be interviewed again? Usually you just drop off the stuff or mail it, you don't really interact with the IO much again.

AFAIK you can't request a new IO. I mean, you could, but I wouldn't count on it to work. It's their job to try to rattle you and yes, sometimes they say things that are upsetting or offensive but that's still part of their job. Why did she yell? I can't say I've heard of an IO yelling before.

You say you "kindly leaned" but to her that could have been an attempt to assault her. You leaned forward, that's a given. She didn't know your intent.

Sometimes we forget that people don't have the same experiences as us in life. You don't know what she's experienced at work. I would be willing to bet more than one IO has been attacked (verbally or physically) while doing their duty. They're like the DMV, SSA and IRS, people always think badly of them when they're just doing their job (and yes sometimes badly).

Also, for what it's worth, they're not typically mean for no reason. I would guess that she's found a red flag in your file so that's why you're under suspicion, people don't react well to liars. I'm not saying you are but if she found something that makes her THINK that then of course she would act differently.

She never toldme our case was under suspicion and not once did we lie to her. She just told us we didnt provide sufficient evidence that we live together. There are no "red flags" in our file.. We have a very straight forward case.

Vanessa- Assault her?? really? I weigh in at a grand total of 110 pounds, not to mention we had to walk through metal detectors to get into the building. She is clearly just another disgruntled government employee or maybe just enjoying her "power" over other people's lives. she has a sign in her office that says "I can only please one person per day, Today in not your day, Tomorrow doesnt look good either." Its sitting right behind her desk, so your forced to stare at it through the entire interview.

Does he have medical insurance you are paying? Have your medical insurance id and his medical insurance id photocopy. Make sure it is under the same policy number it is indicated in the id. Then you can use that as a proof also
