Kindly HELP!!!!

Hello again very one.. I'm needing your advice, suggestions etc. about my case.

I am under 22g because of the employment letter they need from my husband. We sent it and the CO asked additional thing specifically pay stubs from July to present.Before we sent the documents she need I called and talked to a lady [i know her name but never mind] and explained that we can't provide from October till December because my husband didn't get any work from that company they only promised him that he will have work but he just wasted the time to wait. Fortunately last December 27 my husband was hired to a new job and started so what we did we asked a new employment letter from the new company, sent it together with the pay stub of the old company and also with the explanation letter from my husband about the whole situation. We thought that the CO will be happy to know that he started a new job and will give us her YES. Unfortunately, we called today and was advised that it a NO and we will be a public charge, my husband again asked the lady"how about the new employment letter I sent? Can we send my first pay stub?" the lady said yes you can. We faxed it and I called them if they received it she said yes but why is it only one page, seems like they really didn't bother to look up the new employment letter. I told her He just started December this is his first pay stub. I just hang on the phone with no clear explanation from her.

my question is - if the CO will not be satisfied on this is there anything else we can do? or this is the end of our journey?... I am really frustrated :crying: about it my husband and I are willing to fight for our case. Please please HELP us!! Thank you very much in advance...

How about a co-sponsor?

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

Base on your situation, I guess CO wanted at least 3 months of pay stub or at least your husband work for 90 days because usually before 90 days, your husband still probationary which mean if he lost the job, he couldn't get unemployment benefit. If this happen, then you will be public charge.

What's the due date of your 22g? By the end of this March, he will pass the 90 days as probationary at work. But this is not guarantee, things change since unemployment here in US is getting higher. Before, as long as during the interview, the petitioner could provide proof of income above or equal to poverty line.

Thank you very much for replying. Could you tell me how to do a co-sponsor thing in my case because I'm under K3 not CR1 and to honest I don't have any idea about this.

Thanks for the information you provided I appreciate it. Honestly, it doesn't say expiration date but it shows at the bottom we have a year to file for immigrant visa. This is a roller coaster ride. :wacko:

That is a good thought. They could drag their feet for a couple months and have 3 pay studs. But it seems they already submitted what they have and got rejected, may have to go the appeal process route or start over. - sucks.
