Need Help Pls...

I would like to know if I'm eligible to apply citizenship this year or when? I got married 08/18/2003 went back to my country, went back to u.s. as a spouse visa 07/12/2005. Got my Permanent Resident 04/17/2007, I had a short trip from 06/01/2007 to 07/10/2007 (40days) then my marriage didn't work out, We filed our divorce and left 02/07/2009 went back in 01/28/2010 (355 days) in another state then left again 01/31/2010 to finish my child's school then went back 07/20/2010 (170days) from that date I haven't had any trip outside. I talked to the immigration and they told me to take a chance to apply because they don't know if I'm going to be granted or denied because of my almost a year trip. I'm so confused and I don't want to waste my money.

I got confused from just reading this post, give me a couple of months so I can get my head screwed back on again. Think you still have your green card, should be okay if you met the residency requirements for the last five years. Three year marriage is out of the question.

Can you please clarify? You post is very confusing. Did you to go another state or out of the country?

1st trip: 06/01/07-07/10/07 40 days (Out of the country?

2nd trip: 02/07/09-01/28/10 355 days(out of state?

3rd trip: 01/31/10-07/20/10 170 days (where?

Jan 1999- F1 to USA

June 2006- AOS thru D.O.R.A.

Dec 2009- Oath. Finally a U.S Citizen

Much will be determined by the nature of your 355 day absence from the U.S.

Did you quit your job before leaving?

Did you maintain a U.S. domicile? (the place in the U.S. where you live)

Did you have employment outside the U.S.?

Was your return and quick departure for another 170 days purely to preserve your resident status?

Are you over 18?

Are you a permanent resident?

You have been a permanent resident for 5 years or more.

During the last 5 years you have not been out of the country for 30 months or more.

During the last 5 years you have not taken a trip out of the country that lasted one year or more.

You have resided in the state where you apply for the last 3 months.

From the exact wording above, you are "eligible" to apply 90 days before your 5 year anniversary of becoming a resident (4/17/2012). However, be prepared to answer questions about your time out of the country.

I seem to remember reading somewhere, that I can't find right now, that your time outside of the country doesn't count towards the "in residence" time of 5 years. If that is true, you may want to wait another year.
