Timeline

Well today i went to work (been working there for 12 years) and i was told i will be out work effective September 1, 2012.

My question is: I am about to get married and our plans are to start the CR-1 Visa for him right away. Since i am currently working and earning enough to meet the poverty line requirement, will i need to have a sponsor since i will be out of work in September?

Also, does the sponsor have to be a U.S. Citizen?

Thought i had everything in order and can't believe this is happening.

Any thoughts or advise would be greatly appreciated.

If the CR1 visa process is for your spouse that is in the US illegally then this is what I believe is right.

If you start the process now, either this month or next you will most likley have an appointment by the end of this year begining of next year.

If the appointment is next year, you will have to have made enough money in 2012 to support yourself, your husband and your dependants(if you have any). If you will make enough money by September then it'll work out. If you don't make enough money to support yourself and your husband you could get a joint or co sponsor(i dont remember which one its called, sorry). And you'll have to have made enough money to support yourself, husband, dependants that last 3 tax years.

The sponsor can be a US citizen or a Resident, but for them to qualify they have to have made enough money to support them their dependants and your husband.

May 2005- Met my husband

June 2005- Became a couple

September 2006- 1st son born

July 2007- 2nd son born

June 2010- Married

September 2010-Hired our Lawyer

October 15th 2010- Petition Sent in

December 2010- 1st daughter born

February 7th 2011- Petition Approved

August 3rd 2011- recieved our appointment

September 1st 2011- 1st appointment- denied, but approved for a waiver

November 14th 2011- 2nd appointment, turned in waiver

_ _ _ _ _ - Visa Approved (still waiting as of February 18th 2012)

Thank you! This really helps to know. I think my total earnings from now till the time i'm laid off will barely cover it. Just in case, i will have a sponsor ready.

What if the appointment is this year?

Question: I will be getting a good severence pay. Does the severance pay count towards my income? Just a thought.

My future husband is not here. He is in Mexico. We are getting married there soon.

If his interview takes place after September 1st, he will need to submit an updated I-864 reflecting the fact you are out of work (you can include severance pay). The Consulate will have the discretion of requiring a joint sponsor, regardless of what you have made in the year up to that point.

US Citizen or Permanent Resident (green card holder) can be a joint sponsor.
