Divorce does not terminate the Affidavit of Support obligation. He is still responsible to reimburse the government for any means tested benefit that his LPR ex-wife receives. He would need to count her in his household count when he files for his new fiancee/wife.

Exactly correct. The former spouse will be listed in section 21F, where it says....

If you have sponsored any other persons on an I-864 or I-864 EZ who are now lawful permanent residents, enter the number here.

My ex-wife will not be receiving any government benefits, I am pretty positive about that. That should not be an issue. If it takes me adding her on an affidavit of support once again, that will not be an issue either. I understand the times frames are really close together but sometimes you very well can not control these things in new relationships. Unfortunately it did not work out with my ex-wife, I hit if off great with my new girlfriend, and we both want the sames things in life, namely marriage. We do not plan to rush a marriage immediately but I am concerned with any restrictions in the event we do decide to tie the knot and she is ready to become of resident. The fact that she has a tourist visa helps our situation a lot but at some point in the not so distant future we will be planning a wedding most likely and an immigration process will need to be opened again.

Just be prepared for additional scrutiny of the relationship bona fides.
