Returning to Australia after marriage

I have googled my brains out looking for some guidance without any luck. So, here I am. And this forum seems great. I found it last year but never signed up and now I wish I had.

My situation: My fiancé lives in another country. We met online 2 years ago. I went visited him last year for 2 weeks. He will be starting his degree from the very beginning at the end of February and it takes 4 years to complete. I will be graduating college in May of this year. We are planning to marry in the US in September while he has time off from school for 2 weeks. I will be returning to his country to live and work and emotionally support him with school. It's my understanding that after filing for k-1 and marrying within the scheduled time, we should then proceed to adjusting his status. However, we will need to go back right away so he can start his next semester of study. After he completes his degree, we will settle in the US permanantly.

It's important for us to get married because 1) We love each other very much, we will be living together and while we're not religious we are both traditional. 2) If we waited, it seems we would have to wait until he completed school, I moved back on my own and then filed for him. 3) Because we want to settle in the US, we want to marry there. Also my big family can't afford to travel to his country for the ceremony.

In conclusion, my question is, would the k-1 visa work in this situation? If not, what should I be researching into? If I just knew what to look for I could go to town researching. :) But I've hit a road block. I do want to get a lawyer but I would like to have a grasp on the general idea of things first. Also, is our situation unique or common? I've found so much information on the web but nothing that fits exactly.

question is will you be able to go down under to live and work as a Spouse.. LOL>>

you need to look up options of bring back to USA your spouse AFTER living abroad for 4 yrs :)

He should come on the VWP to get married, then you can petition for IR-1 for him when you are ready to move to the U.S.

If you haven't already done so, you will need to start looking into the process of migrating to Australia. You don't have to be married for that - you can start right away.

You can get married anytime, anywhere - then go the CR-1 route whenever you are ready to move to the US to live. As you will be away for 4 years, I'd suggest you file after 2 years for the CR-2; it will save you the hassle of AOS from 2-yr to 10-yr green card. Besides, you will have a tonnes of evidence of a bonafide marriage after 2 years.

PS - Kangaroo meat is CHEAPER than beef these days...IGA supermarkets have a growing choice of 'cuts' ....:-)

Because it's not available in all countries any more and Australia is one of the many countries where it is no longer available.

You can get married anytime, anywhere - then go the CR-1 route whenever you are ready to move to the US to live. As you will be away for 4 years, I'd suggest you file after 2 years for the CR-2; it will save you the hassle of AOS from 2-yr to 10-yr green card. Ooops.... one of those; definitely with "-2" at the end.....if married longer than 2 years for the 10-yr Greencard.
