Can an overstayer beneficiary apply for a fiancee visa in the UK

Hello fellow VJs.i just need to know if an over-stayer beneficiary in the UK is eligible to apply for a fiancee visa to reunite with his/her USC fiancee.An adequate information will be highly appreciated.

You can file while in the UK< but you need to be legally resident in the country you are interviewing in (this will be 6+ months later). So if you are currently in the UK illegally, you will need to go home/ to another country where you are legally resident to interview.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thanks mate.We applied when my visa in the UK was valid and got NOA2 few days ago with few days for my permit to expire.Our calculation was wrong because we thought that our case will get an approval on time so we decided to fix in US embassy london but for now we have no time.

If you were to be in one of the west Africa Countries perhaps it wont be a problem but In an Advanced country like UK I am pretty sure it is a No no...Unless you are heavenly favored however, there is nothing impossible with God but I wont gamble with it. I suggest you write NVC immediately to have the case transfered to Lagos consulate. The development will only set you back by 2months cos from all indications, UK Consulate is not backlogged, I once switched embassys as well.I think it is worth it than to have your visa denied. Penguin is right, Your visa needs to be current at the time of your interview...It is just good to cover any loopholes ahead of the embassy journey because the whole visa journey could be very frustrating but sweet ending.
