Hi guys,

I have a question... I'm a full time college student with no job. We just applied for a K-1 visa and I just started gathering all the documents for the next step. My question is... I don't have any source of income, I get money through my school's financial aid, what kind of people can fill affidavits for us? my parents? his uncle? my friends? and how many affidavit do we need? 1? 2?

You fill out the form, include your tax returns (past 3 years). If that is insufficient, have another person agree to joint sponsor your fiance. They will need to fulfill 125% of the poverty guidelines for their household size plus one (your fiance).

As far as I know, the only requirements for a cosponsor is that they have filed taxes for the past three years, earn %125 over poverty level for household size, and are US citizen or permanent resident (will need to provide documentation proof). If the cosponsor has sponsored someone previously, they will need to provide documentation for that as well.

They don't even have to live in the same state.

I am in the same boat as you, and I have to file for co-sponsor. I believe Any US citizen can co-sponsor (doesn't have to be family/relative) as long as they meet the necessary co-sponsor financial requirements.

They may ask about your relation to the co-sponsor at the interview stage, so just be ready to address that. We were asked about who ours was and how we were related or knew each other. I think this is really only a concern where there might be suspicion of fraud (e.g., you met your significant other through your boss who then becomes your co-sponsor...).

I think that the OP is filing for a K-1 visa, and could use Form I-134. I believe the poverty level fulfillment guidelines are different for Form I-134 (100%) vs. Form I-864 (125%), please refer to K1/K3 FAQ .

I think that the OP is filing for a K-1 visa, and could use Form I-134. I believe the poverty level fulfillment guidelines are different for Form I-134 (100%) vs. Form I-864 (125%), please refer to K1/K3 FAQ .

YMMV.

However, many of the consulates go by the guidelines for the I-864, even when using the I-134 at the K-1 visa interview, and look for 125% since that is the amount that will be needed soon after entering the US when they file for AOS.

Only one of them can be the co-sponsor, so for example we will say your father is. His household size would be himself, his wife, their son, plus your fiance. This means he will need to make 125% of the poverty level for a household size of 4.
