Form I 864

Hi everyone,

I have a question regarding form I 864. We are married and about to send documents to USCIS. The father would like to sponsor me however he makes around 22000 claiming two more besides me. which brings the household size to 4 of total(including me). it is clear that his income is low(to sponsor me) but other two family members get financial aid from school which adds around 9k a year. in form I 864 part 24(b) asks if there is any other source of income. My question is can those two family members add (claim) their financial aid income that section which will bring the total household income to 30000 or more which is approved by 125% poverty line.

Financial aid and/or student loans aren't considered income. You'll need a different co-sponsor.

Income = money you make. Financial Aid = help from government because student's family has low income. It is definitively not an income. You have to find another co-sponsor or an asset worth 5 times of the missing portion of 125% guideline (For example, you are short of 2k -> the asset needs to be 2k x 5 = 10k.)

Assets only need to be 3x in the case of the spouse of a USC. Nonetheless, as stated, financial aid isn't income. It's more equivalent to debt.

currently for 2010 income 22k surely it is more for 2011 but have not received it yet. also there is few thousand dollars of stock options. is owning a car which is paid for can be accounted as an asset the value of the car is 8k.

it would be better of to find a sponsor but truth to be told do not know many people that willing to do this.

do prove of stocks and title of the car must be present along documents?

There are instructions for what sort of assets can count on the I-864 instructions. A car won't work if it is your only car. The idea is that to sell if would bring a hardship to the family. There are more details in the form instructions.
